I believe we could probably prove negligence on their part, but their exclusion of liability (which covers almost everything, would probably get us. I think it would depend on what perishable goods and a controlled climate is classed as. Alcohol is not perishable in the sense of going off and we are not claiming it needed to be within 15-25 degrees. That said we probably wouldn't win in court, which is why we are aiming for some good will on their part and pressure on our companies part (why use a company that fails this abysmally again?). And yes it is a UK company and contract so we are going though them.
Well yes, that is lucky in that respect. As I said though, this shipment SHOULD have been insured, like the other two were. Somehow someone took their eye off the ball on this one. Hence my "if you want something done properly do it yourself" attitude
Without insurance, this could have caused a whole lot more grief with General Averaging. If part of the cargo is lost to save the ship, the owners (or their insurers) of the cargo not lost pay those who lost out, proportional to their shipment in the load.

That said, that attitude doesn't really work. Do you expect all shops in Canada to have their liquids stocked up in September for the entire winter? This isn't the 19 century any more.

It wasn't meant to be shipped at this time of year... All our other shipments arrived in October. That may be part of the problem.

My guess is that "suitably packed" would cover sufficient restraint , padding to prevent the bottles breaking, not temperature control.
I knew of those temp controlled containers, didn't know they were called "reefers". The susceptibility of the plugs to "fall out" in customs clearing is, I suspect, a direct contributor to the cost of meat and cheese in Nigeria.
