Returning Resident
 

I am Canadian Resident holder. I have done Master in Computer Sciences. I
got Immigration status in April 2002 and I entered into Canada in the same
month. I stayed there for couple of days and returned back after completing
my necessary documentaion. The reason I came back is that I wanted to
improve my technical skills as my current employer wants to train me in more
advanced tools. I hope these tools will benefit me in getting a good job in
Canada. So I was planning to apply for Returning Resident permit becuase I
wanted to stay outside canada for more than 6 months. Now as per the new
rules, there is no need for Returning Resident Permit. I want to ask you
that will this rule be applied on me or not as you know I received the
Landing papers before June 28, 2002.

its quite simple really.. if you fulfill the 2/5 years residency rule, you should not have any problems returning as a PR...

you should be able to stay out of canada till march 04, provided ofcourse once you return you never leave for the next 3 years or you lose your pr status... thats the catch...

same rule for everyone, you have only been out of Canada for 4 months or so so you
should have no problems returning now. if you want to stay out longer then just make
sur eyou return in time to get the PR card and stuff.

After Dec 31, 2003, he's going to need the PR card to re-enter Canada.

correct... but in his other posts to this forum he claims to have already gotten the PR card...

since he landed in april and returned in a couple of days, and the pr cards were definately not in circulation then, how he did it i have no idea...

I think he said he 'completed his documentation.' Whatever he means, he doesn't have
a PR card, they didn't exist in April.

He may still find a CIC officer questioning whether his landing was valid in the
first place at some point. This could occur when he comes back to Canada and applies
for the PR card onshore.

Completed Documentation mean I received my SIN Card and open accout in a Canadian Back. Definitely I did not apply for the PR card, because I can only apply after october 15.

2ndly how u can say that my landing was valid or not. In my first message everything was clear, so please first go through it before saying such statements.

He can make that statement because of what the Immigration Act states.

19, who seeks to enter or remain in Canada must establish,

(a) to become a permanent resident, that they hold the visa or other document
required under the regulations and have come to Canada in order to establish
permanent residence; and
---------------------------

You never came to Canada "in order to establish permanent residence". Getting a
SIN card and opening a bank account does not prove that you came to established
residence. The fact that you left Canada after a couple days, are still
employed outside Canada by the same firm, and still live outside Canada clearly
prove the opposite.
