also i have property in the uk so i would have to visit so that i could put it on the market to sell, would i be able to visit the uk and then return to canada while my process was being done?
i know that we would have to live together as man and wife for a yr before my then husband could sponser me but in the mean time would i be able to work and would the children be able to continue their education....

You can get married and go back live in the UK and your husband in Canada. And apply for immigration for a spouse outside of Canada. That's how we are doing it.

Also a spousal app outside of Canada is the fastest way to PR. The downside is that you can't live with your husband in Canada while the process is happening. The upside is that you can work and keep your life as normal as possible while you are waiting. This is really important for the children.

Re: re The Wizzard (+ all)

Firstly you only have to live together for a year as man and wife if you are
intending to apply as commonlaw partners. If you are getting legally married
as yousuggested in an earlier post then you can apply as soon as you are
married, although it will take a while to get all the forms ready and
marriage certificate back and all that.
Although i got married in Ontario i did not stay and apply inland as i had
to come back to the UK and finish my last year of university (otherwise id
be living in Canada and a PR by now im sure). So we applied via the outside
route and got slightly delayed as our wedding certificate took months to
arrive and other things got delayed but now im jsut waiting to do medicals
for CHC London then its the last stage waiting for passports to be stamped
etc.
If you apply inland after getting married then *technicaly* you arent
supposed to leave Canada during the process, however sometimes you have to
and from what i have read in one of the yahoo groups (canadian_immigration)
which is mainly inland spousal people they have had no problems leaving to
say visit family etc (both to US and europe) as long as when they returned
they had all their paperwork with them and could prove they were in the
proces sof applying for inland PR, in fact a few of them actually commumte
to the US everyday to work.
This will be your main problem applying inland, you cant work as you are a
visitor and youhave to wait until you have been Approved In Principal(AIP)
before you can qualify to get an open ended work permit and currently thats
taking 6-8 months so bear that in mind, if you applied from outside you
could probabyl complete the entire process in the time it takes to get the
AIP and work permit from within providing yoru case wasnt too complex.
your children could go to school though according to the new law children of
inland PR aplicants no logner need to apply for student visas however they
may still charge you fees as your children arent PR's or citizens so are
technicaly foereign students and it can be quite pricey but some schools
dont so that area seem s a bit vauge.

Re: re The Wizzard (+ all)

Can anyone elaborate on what Wizzard just said about children of inland
applicants being able to go to schood before AIP is issued?
Where can I find more info on this?

Thanks,

Igo

Re: re The Wizzard (+ all)

Can i jsut ask you at what date CHC London receoved your application and
what stage you are up to?
My wife was approved as a sponsor on June 5th and CHC received my
application on July 25th and i have an AOR so far. A Fax from them on
September 18th told me they were starting processing applications received
on July 11th but they dont appear to have reached mine yet.

Re: re The Wizzard (+ all)

By ' whole process' you mean the marriage license and wedding?
Was is Saskatchewan?

I copied this from a website:

Saskatchewan :
Where to Get Marriage License: They must be purchased from marriage licence issuers. Jewelery stores or town administrators generally provide this service.

ID Requirement: Canadian citizens must present a valid driver’s licence or birth certificate. Non-residents of Canada must present their birth certificate. Immigrants must present both a valid birth certificate and their landed immigrant papers.

Residency Requirement: Do not have to be a resident of Saskatchewan.

Waiting Period: 24 hours.

If Divorced: Divorce documentation must be provided. They will accept the original or a court certified copy of the "Decree Absolute" of Divorce or the original or court certified copy of the "Certificate of Divorce."

Previous Annulment: The original or court certified copy of the "Decree of Annulment" of marriage must be provided. You cannot remarry until 30 days after an annulment is granted.

Widowed: Proof of death is not required. However, you need to know the exact date and place of death of your former spouse.

Fees:$50.

Other Tests: No other tests necessary.

Under 18: Applicants under 18 years of age but over 16 need to have parental or court consent. The consent form must be signed before a Saskatchewan marriage licence issuer, the clergy performing the ceremony or any person authorized to take affidavits. No one under 16 may marry. However, a judge of the Court of Queen’s Bench or a judge of the Provincial Court can override this.

Cousin Marriages: Yes.

Proxy Marriages: No.

Same Sex Marriages: No.

Witnesses: Two over the age of 18.

Miscellaneous: License is valid for 90 days.

Copy of Certificate of Marriage: Saskatchewan Health Vital Statistics and Registration Unit
1942 Hamilton St.
Regina SK S4P 3V7
Phone: (306) 787-3092
