quick question regarding common law residence
 
Quick one for you i wish to be sponsored to live in toronto and i understand they have now dropped the lico for such sponsorship but what i dont know is it says to live a year with yuor common law could i come for 6 months go back to the uk then go back for another 6 months then apply ?? or would i have to stay a full year somehow maybe on a work visa ??

any help would be greatly appreciated

for the commonlaw partner category you need to be living together for at
least a year as a 'married couple' so basicaly everythin is joint and shared
as it would be ifyou were married, that is what commonlaw marriage is, you
are considered married even though you have peformed no legal ceremony etc.
In yoru case your partner lives in Canada and you dont and you can't cohabit
for a year because you cant get the right visa to live and work in Canada
for a year to do it, which is why there is the 'conjugal partner' category
for serious relationships but where they cant cohabit because you are
indifferent countries etc (you cant use the conjugal category from within
Canada) or because you can marry because you are same sex partners etc.
so really the commonlaw category is more going to be used by say people who
have gone to Canada on a work permit or student visa and then met someone
been living with them for years but they arent for mariage etc, or say if a
Canadian is living in another country and meets someone but they dont want
to get married.
so you can either try and get a work permit and go there or go as a visitor
and live together for a year or you can get married or you could try the
conjugal partner category if you can prove that your relationship is over a
year old and is as serious as a marriage etc but the only reason you arent
together is immigration.
