Parents Application: Mr Miller?
All experts, actually....
Could you clarify the following point? I am planning to move to Canada soon, visa is almost ready. I am wondering how long after landing do I have to wait to fill a family sponsorship application for my mother? I know there is a certain income requirement, but is there a time requirement as well? Appreciate your help. |

Before you can apply to be approved as a sponsor you must demonstrate that you earned
the minimum required income from Canadian sources after landing and within 12 months or less prior to application. -- ../.. There is no specified time limit, you just have to meet the LICO amount. So you have
12 months to earn that amount. You have to actually have earned it as well, you cant say you have a job that pays say $40,000 a year so thats my income for 12 months, you have a period of 12 months previous to your application beign submitted during which time you must have met the LICO amount, less any debts etc on the form. So unless you land a pretty nice job that pays thousands of dollars a week it's gonna be a while before you reach LICO, especially if there is more than you in yoru family unit and it pushes you up into the higher bands. Is it "minimum required income from Canadian sources after landing" or is it just "minimum required income from Canadian sources"?? The reason I ask is, I believe the LICO requirement just stipulates income from Canadian sources in a period of the preceeding 12 months, the fact that the person's legal residency was not as a permanent resident does not matter, provided ofcourse that the income was obtained while the person was in legal status. I guess what I am getting at is, say a person has been in Canada on a valid EA, and after he/she lands as a permanent resident, their income for the previous 12 months has been from Canadian sources, and if they meet the LICO, they may sponsor their relative immideately, not having to wait for 12 months after they land. Yes, your understanding is accurate - person who was legally in Canada on EA and then
became a PR will be able to use pre PR income to meet LICO minimum, as long as it is calculated only within 12 months prior to application to be approved as a sponsor. But all of that may change after June 28 - as of now we don't have yet new sponsorship kits and Immigration Manual, so we need to wait. -- ../..
