New and Old rules for oldbie
 

Hi,

We live in the UK and had made an PR application back in November 2007. I'm in software development (principle candidate) and really thought I saw my skill on the list back then. I certainly got a job code from their web site and have recently seen less job types desired and new rules.

I want to know how they'll process us given that I applied before the new system? For instance we were under the impression that so long as we both met there points criteria, eduation, healthy, can work etc. they'd consider us.

We've had all the "we'll give your money back if you've changed your mind" letters.

Would it be worth appealing if we didn't get in?

Hi,

There was no "list" when you applied (the one introduced in Oct 2008 was the first ever 'in demand occupations' list there has ever been) so don't know where you thought you'd seen your occupation back in 2007? You may have seen it on the NOC list, but that has pretty much every job ever created, it's got thousands on there!! That just tells you which skill level your job falls under.

The only criteria in 2007 was the points system, so if you are sure of your points then you should be fine (assuming of course you pass the medical, have the required funds, etc).

Thanks for your quick reply. I looked through our paperwork, letters they'd sent and forms we'd filled in but couldn't find anything.

I'm not saying your wrong but we used the NOC list back in 2004 as it listed jobs that were in "demand or in shortage" (as far as I know) and that is also where we abtained our NOC No. If your job weren't on the list you had no chance unless you had a job offer with LMO etc etc. As we applied quite a few years ago i'm pretty sure there may have been new rules introduced in that time (don't ask me what they are?). If i'm wrong apologies in advance..

From my understanding, the NOC list has only ever been used to tell which skill level your jobs is (and therefore whether you qualify as a Skilled Worker if it's skill level A, O or B). Are you sure you're not thinking of the OUP lists? Very different thing but not relevant to PR applications (only for TWP applications). But that was/is the list of 'jobs in demand'. You didn't have to be in one of those jobs to be accepted as a SW, just to have the requisite points etc.

In any event, the OP doesn't have to worry as his application will be processed under the old rules so has to meet the old qualifying criteria only, i.e. enough points, passing medical etc.
