My partner working in Canada to?
 
Hi,

We applied under the old points system. At the time we considered applying seperately or on one VISA with me as the primary candidate. Presently in the UK we both work. But because she wasn't likely be working 2 or 3years in a 5 year period, it would be tricky for her to forefil the PR requirements so she was put down as my dependant. Also we thought about the possible situation where she or I was let in but the other wasn't.

Thing is, we're now thinking, what if she wants to work as presently in the UK we are a working unit so to speak and both incomes supplement each other to make our life here.

Shes degree qualified and presently works as an administrator for a construction company and as their ISO quality manager.

What we want to know is, can she work if we're given this PR visa? Her income when she does will help, just like it does in the UK. In fact I think we'd struggle without it right now, certainly until settled but like I said as she does now, she might not be working all the time.

What are our options?

Hi DC.

If I've read the above right and she was on your PR application, plus you meet the criteria for common-law partners (i.e. live together and have done for a year or more), then she'll be granted PR - so will have exactly the same rights as you, including the right to work.

I don't understand what you mean about her not working for 2 out of every 5 years so being put down as your dependent though? She wouldn't have to work for 2 out of every 5 years to keep her PR status, just be resident in Canada for that time, regardless of what she's doing there work wise. And she'll have to fulfil that requirement anyway if she's granted PR via you.

Hope that helps clarify it a bit.

Thanks. I wasn't sure if a dependant could work or not on our PR application. Perhaps I shouldn't have waffled.

Yes, she'll get PR too so will be eligible to do all the same stuff as you. But she'll also have to keep up her residency requirements or lose PR.
