A few years ago the rules changed so that a spouse can actually remain in Canada while PR application is pending. There's no requirement to get a visitor visa extended. Technically you can be told to leave but likely only by doing something that would cause you to be thrown out anyway if you had a valid visitor visa ...ie some sort of offence.

In the usual case of CIC not knowing their arse from their elbow, I was asked to renew my visitor visa while our application was pending. That was puzzling for two reasons; it had already expired and the website said visas had to be renewed before expiry, so how could something expired be renewed? and the other reason was the new rule saying it was not necessary.

Having experienced the inefficiencies and inflexibilities of CIC by then I played their game and I did apply for a visa renewal but I enclosed a letter saying I thought it wasn't necessary in view of the new rule. They agreed and returned it the application and fee.

Forgot to say...I was also advised by CIC I could apply for an open work permit enabling me to work while the PR application was pending.

If you come over as a 'visitor' then get married in Canada - what happens after that? Do you immediately apply for a spousal wotsit? Is there any requirement for having lived together a certain amount of time?

If the newly married visitor cannot get the visitor visa extended (for whatever reason) does the newlywed then have to return to the UK?

My brain has gone down the "this must surely get abused" route :sneaky:

That's what I did. Came here in the January and was married in April. Its the marital inland spousal application that was the tricky part, not the marriage itself. You don't have to leave. I was allowed to stay on a visitors permit while immigration processed the application.

My husband and I (both UK citizens) went to Toronto on holiday, we arrived on the Wednesday and got married on the Sunday at Niagara Falls. We were on holiday for10 days. We now have PR and are landing Feb 14th.

If you want to get married in the UK and one of you is subject to immigration control you would have to give notice of your intention to marry at a "designated" office. Your local register office can tell you of your nearest one.
You would both have to be resident in the UK for a minimum of 7 days and then wait another 21 days for your actual documents that enable you to get married to be issued.
Hope this helps!

We (both UK citizens) got married in Nova Scotia whilst on holiday there last year......very easy!!:)
