No, that would be if nldfc had intentionally borrowed with the knowledge that they would not pay it back.

He defaulted - this is neither theft nor fraud. Defaulting on a non government debt is not a crime.

It must be very tempting to leave debts unpaid in the UK if your credit history does not follow you.

It is relatively easy and cost efficient to chase people around the world for payments of debts, particularly England to Canada. Don`t assume they won`t find you in Canada and, when they do, you will have a judgment in Canada as well which will affect your credit history in Canada.

I used to do this regularly in England and I now act for those wishing to enforce in Canada.

They aren't going to come after you ten years later. Your debt has been written off long ago.

To anybody caught by this situation I'd just offer them 10c in the dollar. They'll probably accept it or counter offer with something less than the full debt.

True - I had 2 fraudulent transactions on my Amex card, several years after moving to BC. They were for flights purchased at Luton airport.

I knew nothing about it until a debt collection agency called me at 2 in the morning here demanding repayment. It took months to resolve.

Is there a time limit on how old a debt is before it is written off - I seem to have 7 years in my mind for some reason but that may have nothing whatsoever to do with debt :blink:

Don't worry, we have $14k already in the bank, and will have about $18k on arriving in Sep11.

We ALSO have debt which we are paying off, which is what this question relates to.....

I just know how much we have spent on setting up in Canada and it's way more than $18K, plus if you don't have a job to come to it may take longer than you think to find one.

Statute of Limitations - 6 years from the last occasion you legally acknowledged the debt. Check this if you ever want to rely on it though - it's been 15 years since I studied UK banking law and the Statute of Limitations on my memory is much less than that...

If this is becoming a "debt confessions" thread, I'll be honest, I've not yet informed SLC about my move to Canada, and I left behind around £30,000 of student debt.

I'll get round to paying it off eventually though I'm sure...
