Hi Mr. Miller...

I have been going through the new proposed Immigration rules (for Canada) that will be effective from 28-06-2002. I am interested in applying for a PR under the independent
category. I calculated my points under the new system and it is 78.

If the proposed pass mark is ultimately set to 80, does it mean that I will stand no chance of qualifying or might there be any other provision by which there will be a possibility to qualify?

Final pass mark is not established yet - the 80 points is just the proposed pass mark
and it still may be lowered by the time of final publication of regulations.

But is you calculated your points correctly (most people don't) and you scored 78
points then you have a chance even with pass mark set at 80 - processing officers
will have the discretionary power to approve cases not reaching pass mark if in their
opinion applicant has very good chance for successful establishment in Canada. So,
the perfect preparation of your application package and strong presentation of your
qualifications, skills and abilities will be the key to succeed.

Thank you for your prompt respose.

You were right in saying mostly people don't calculate the points correctly. I also made this mistake but that was while adding them up. It is 76 instead of 78. However your reply did make me feel a bit comfortable. I shall now pen down the details of how I calculated my points as per the new system as you might provide me with some more suggestions.

Here is a background info about me. I'm an Indian married for last 1-1/2 years with a newly born son who is 25 days old. I wish to be the principal applicant.

Points calculation (under proposed system)
-------------------------------------------------------

1. Age - 10
(Both me and my wife are 26 yrs. old)

2. Education - 20
(I'm a Bachelor of Commerce Degree holder from University of Calcutta, India in full time course and completed 15 yrs. <10+2+3> of education)

3. Language Ability - 16 (4+4+4+4)
(Me and my wife are both fluent in English in all the four categories. I have a TOEFL score of 633 in 1996)

4. Work Experience - 25
(I've been working since November 1997 as a Computer Programmer and this profession is listed in the new NOC with skill level A or B)

5. Arranged Employment - 0

6. Adaptability - 5
(My wife is a Master of Arts degree holder in Political Science with 17 yrs. <10+2+3+2> of education).

TOTAL POINTS - (10+20+16+25+0+5) = 76

Over and above I'm am currently doing MBA from University of Calcutta which will be completed in May 2003. Will this info add value to the application since if I'm granted a Visa, by the time I get it, I'll have the degree. I do not wish to wait for long because as it is the New Delhi post is taking years to process an application.

Would you be able to suggest my chance Mr. Miller?

Seems that you have calculated your points correctly this time. But number of points
scored in selection grid is not the only factor in the process and without knowing
all details of your case I can't tell you what chances you may have. More - even if I
would have all necessary information and would on that base tell you that your
chances are good it doesn't mean that you will be accepted. Statistically every 3 out
of 4 applicants are refused, many of them qualified but with poorly prepared
application package.
