How / where to divorce, (all friendly, everything agreed, very amicable)

Default How / where to divorce, (all friendly, everything agreed, very amicable)

Would anybody be able to help me with the above? We have decided to divorce after being separated over 4 years, it by mutual choice, no 3rd parties.

We are still very friendly, everything is amicable, we have agreed on the division of assets. We have one daughter and everything works out fine there, after 4 plus years this is only really a formality.

We are living in NS and our priority is to keep cost and stress down to the minimum.

You file for divorce where you live, so as long as you haven't moved between countries or provinces/ states etc. within the past 12 months then you'll have no problem. If you and your spouse live in different provinces or countries you would still file where you live - if your spouse wanted to take the lead then they would file where they live.

Throughout Canada one has to have lived in a Province/Territory for at least 1 year immediately preceding the filing of the divorce paperwork. This is a link to the Nova Scotia Court's website that should give the OP a start: Divorce in Nova Scotia

I got a divorce in the UK many years ago. Similar to you we had agreed division of assets, and had moved on with our lives, although there were no children in our case. We discovered that you can just fill out the forms yourself and if I remember correctly I paid a total of £40 for the court time and paperwork. That is most definitely the way to go to keep costs and stress to an absolute minimum. Check to see if the no lawyer route is an option where you live and if it is, go for it.

If no lawyers are involved the cost of divorce is pretty minimal, just the court fees really.

When my ex and I divorced we filled out the forms, went to the local courthouse paid the fees and filed. About 6 months later is was done and over with, no court visits no additional fees.


Can't recall the exact fees, but it wasn't a huge amount.

2. Joint application for divorce – spouses apply together for a divorce

can only be filed if both spouses agree on all issues, including parenting, child support, spousal support, and property division
can only be based on one year's separation, and documents can only be filed after the one year has run out

I got divorced in NS a few years ago, with very little fuss. Just filed the papers and the fee at the court, didn't even need to to to the hearing, just received my finalised divorce papers sometime later. Very easy and painless.

Don't forget to state how the pensions are to be divided, canadian and any UK ones, or else it may come back to bite.
I used a legal firm here in bc, they thought of many things to my benefit, that had not even crossed my mind
