frustration.com when will it end???
 
hello there,
where do i start....Any advice welcomed???

in 2011 i sent an application for the FSW and had it returned as i had not ticked a box (which office would process my application). fair play i completed it and sent it back. due to the postal strike etc in Canada causing massive delays i recieved an Email to say that my application would not proceed due to insufficient evidence that i had minimum 1 years experience in the listed profession (id sent current contract and specifics of my role and 3 years experience with dates).

i was advised that i would have to send a complete new application, however my original document for language test had not been returned so i managed to find an email address and asked what happens next??? would they keep the document on file in Canada and if so should i just send my application with additional evidence and they would put the 2 together in canada.
i kept getting an unclear response of " you were advised when making the application to photocopy all documents" i therefore sent the application package off again with a copy of the language test enclosed.
2 days after sending the pack.....yup my original language test certificate was returned. i quickly returned it with a covering letter explaining what had happened hoping the 2 would be put together.
this was unsuccessful and i was advised that my application could not proceed as it was incomplete (no original copy of language test)....and breathe!!!: blink:
then i was advised of a job being advertised so i applied along with everyone else, was short listed and interviewed...and yay i was offered the job. so i decided that my best bet was to go down the temporary work permit...however i have sadly just been advised that the company have been told they need to prove that the job couldnt have gone to a canadian...surely this was proven through the whole advertisement, shortlisting and interview process???? plus the job is on the list for FSW which highlights a need for the role in Canada???

to say im exhausted is an understatement....im a straight member who just wants to work and live in Canada!!!

im now thinking ill have to revert back to the FSW application however CIC have still not sent my original language test cert back to me.

what makes it more difficult is lack of people to speak to on the phone...is there a number available anywhere???
i completely get that they are inundated with applications but really does it have to be so difficult???

any words of wisdom support will be welcomed with open arms

Just wait until you (hopefully) live here - it doesn't get much better!

It's no worse than most places. I find in business that the answer is always "yes", then the delivery falls short. It can just be frustrating getting one straight answer to a question. No-one wants to offend or disappoint I think.

yup.. CIC is like that, it is very tough to get an actual person on the line. We do have now 3-4 times a year access to such a person to ask questions to, but have been told that only generic questions..not case specific questions will be answered. ummpfh...not really that helpful, but better than nothing? (I am working with settlement)
As for the WP, yes, the company has in most of the case to apply for a LMO (Labor Market Opinion) and there are pretty stiff rules and regulations about how to go about it (enough and precise advertising is one of them). This doesn't mean that the company wouldn't be able to get one, but it means they have to jump through a few hoops (paperwork) for you and make their case.
Where do you plan to go to? Would PNP be an alternative? You still have to apply for PR afterwards, but once nominated the LMO requirement is lifted and only police check and health checks are done federally.

What else did you supply though? Just what you've stated above isn't enough, what about references from your employers outlining your duties etc?

Yep, but they do need to document it though - they may have 'proven it through the whole advertisement, shortlisting and interview process', but how are HRSDC to know that if they haven't documented it? They have to prove it, so provide proof of the advert and that no Canadian willing, or able, to do the job applied.

Unfortunately, the fact that the job is on the list of eligible occupations for FSW makes no difference either - the LMO application is sent to HRSDC, not CIC. And it's a different set of requirements for a TWP.

I understand how frustrated you are, but CIC do have a set of requirements and rules to follow, and if you don't meet those then unfortunately you will have problems. It seems that you've perhaps not fully understood some of those requirements, but I'm sure that you'll get there in the end, particularly now you've found this forum to hopefully help!

Best of luck with your next step, whatever you decide that may be. Which NOC code were you going to apply under as a FSW, is it one that you can still reapply under or has the quota been met since you first applied?

i sent them signed copies of my current, signed and dated contract and statement of particulars, obviously wasnt enough,. i then advised them that due to the canadian postal strike i would courier over a letter from my employer explaining that i am still employed and under what title but they stated that additional info wouldnt be accepted and my file had been closed.

it was a local government position in BC so they have to follow certain equal op policies anyway which they would have written proof of throughout the process. i went through a full process and out of all the applicants i was offered the job...which they then had to withdraw the offer because of LMO because of lack of clarity im not sure the local government HR team fully understand the requirements so are confused themselves.

my job is still on the list of desired occupations for FSW so im back to following that route. i suppose im just disappointed at the possible time scales and the fact that reading on here that so many people have and are being honest and above board to follow their dreams and getting no where fast.
where im sure there are others who will attempt to be underhand and get away with it at a cost to others.
sorry i know people have processes and jobs to do i was just looking forward to a move soon!!!

what i also dont get is if an employer cant prove they couldnt employ a canadian for such a specific role which needs qualifications, degree etc how do they ever do it for a role which isnt so specific....am i being thick???

as for contact with CIC i suppose its just frustrating that there were things i could have answered on the telephone but instead they just sent it all back.
and now i have to wait for my language certificate to come back before i can reapply...such a delay!!! theyve had it since October.....

arrrghhh im depressing myself even more....apologies i know i will get there im even more determined now x

im not sure about the pnp as an alternative.... i need to look into it in more detail i suppose to check. its so difficult when you cant clarify things properly

Ah, I see. Unfortunately, you do have to meet the criteria at the time of applying, and without full references outlining your duties, there is no way of CIC knowing that you did. Even just a letter from your employer with your title in wouldn't have been enough, he'd have needed to outline your duties as well - to qualify as FSW you have to prove you've done most of the 'main duties' listed under the NOC code, so if you didn't provide proof of that unfortunately that would be why CIC rejected you. Plus the document checklist asks for references from the past 10 years, not just your current job.

They don't. That's why so many LMO's are rejected!

As I said above, you have to meet the criteria at the time you apply, and include everything on the document checklist. CIC don't really do phonecalls!

Can you not just re-take it? I know it's another chunk of money, but it may well be quicker, and could be essential if your NOC code is nearly at its quota.

You will. Definitely persevere, and maybe get an immigration consultant to check over your forms and evidence before resending them, just to make sure you don't get rejected again?

Which province were you going to? PNP could well be an option. CIC won't clarify anything like that for you, if you want professional immigration advice I'm afraid you'll have to pay for it, although most consultants/lawyers will do a free initial consultation to chat through your options.

its british columbia and the noc is 4152 social worker. ive had all my qualifications accredited so thats one job out of the way.

i could retake my language test i suppose but apparently it now says on the new document check list that you may not need the original if you have the email from original application to say it was rejected......im literally dizzy with it haha at least i can still smile hey

If you still wanted to go for the job in BC, have a look at BC PNP - it might be the answer and once nominated you can be issued with a work permit whilst your PR application is being processed.
