son attacked
Ok this is hard for us and we never expecting this.
Saturday night we got a call saying our son is unconscious in our local town 5 mins away at 1.am we got dressed and was in town within 5 mins, our son had been hit by a foreign lad with what they call nunchuckers (Bruce lee stuff) This lad had been removed from the pub by the bouncers. my son walked outside to get some air, as he walked outside the foreigner was hitting another lad with them and my son got hit aswell across the chest to which he went back inside to get help not much you can do against sticks on a chain. on coming back out the foreign lad had disappeared, our son got so worked up about this he complained to his friends of a pain in his chest they told him to see the medic parked outside he went outside sat in the medics car and then passed out lying on the floor. His mate called us and we was there within 5 minutes. Our son is 18 almost 19 and to see him lying on the floor not moving is the hardest thing ive ever had to deal with.. he had hyper ventilated and passed out although we did not know this at the time as we had cardiac and paramedics on the scene as well as an ambulance. you can imagine what is going on its so scary its untrue if i had the lad that did it he would have been a lot worse off than my son. we got back from the hospital and put him to bed we struggled to get to sleep at 3.30am we heard a noise outside, i went outside and a car accident had happened the driver was thrown out from the car and lying in a pool of blood from his head the 2 passengers walked about calling friends on mobil phones i have never seen so much blood. what a shit night we was having, The ambulance took them to hospital. Ive just had news that they are all ok no serious injuries. I thought it was going to be fatal. what im trying to say is the 5 mins it took to get to town seemed like ages and this is the first negative thing ive come up against moving out what if we are in Brisbane and something happens its a bloody long way, im a tuff sod but when its your own it hurts bad. I know its the right thing in moving away and wish and hope he changes his mind and comes with us. The police have released this other lad on bail can't understand why they have it all on film. In 5 years of trying to get out this is the first time ive ever questioned what our plans are shit its scary, but then look at the justice system the police have no powers it feels like the working class Englishman is shafted again maybe im ranting but dam im mad, its a clean and cut case assault with a deadly weapon. cant finish this yet as its ongoing police coming round tommorow and thats only because we phoned them and demanded to know what was happening. thanks sid |

Sorry to hear about your son's experience. Hope he is doing well. Unfortuantely this sort of stuff goes on no matter what country you live in it seems. You'll certainly hear similar stories in OZ and NZ.

I am only assuming here but I do not think the necessary evidence is enough to charge the suspect at this stage. The police have no decision in charging and remanding this person to court; that decision is made by the Crown Prosecution Service. They will require as much evidence to ensure that they have a fighting chance at court. Hence the reason why this person was bailed. CCTV will play a part, however so will potential witnesses to this; and there is every chance that if this person remained in custody today all the information needed would not have been gathered; hence the reason to bail the person to allow evidence to be gathered. There may also be forensic evidence and this takes time to process. That evidence will then need to checked by the CPS, they may require further stuff, so good chance this guy is out for a couple of months on bail. It would appear there are other victims, again lengthening the process. Do you know what he was arrested for in relation to your son? Has your son given a statement? If not another reason why he was bailed. Frustrating yes, but good news he was arrested. I hope the officers give you some answers and I hope you can see where I am coming from. |

The law here is no better. A few days ago a guy who is in his 40s (an associate of a street gang here) was allowed to walk free after a road rage incident in which he stabbed another guy and his 16yr old son.

We have similar problems. For example you can use "reasonable force" to defend your home and family, but that is open to interpretation as it is linked to the victims perception of the danger and what force or intimidation is actually used. In the US you can just shoot intruders, which I kind of agree with as nobody has a right to force entry into your property except the police etc who WILL announce themselves prior.
