Default Britains immigration cap declared unlawful by court

Interesting times with British Immigration. It seems Cameron is in a corner he needs to cut immigration yet he can't cut it from the type of immigration that Britains want cut the most (EU) A limit of 1000 so called Highly Skilled Talented Visa's has been described as Laughable by the Commerce sector and will stunt Britains growth.

This affects people migrating to Australia as well simply if the 500k or so Australians that Go to the UK can't work there well then the need for migrants from the UK will decrease significantly. Already on another forum all the IT SS from Victoria seem to be gettign rejected.

It now seems that the controversial limit imposed on the number of non-Europeans that are allowed to settle down in Britain has been described by the British court as being unlawful. This has, of course, dealt a new fresh blow to the government’s take on emigration.

High Court judges ruled that home minister, Theresa May, has sidestepped parliamentary scrutiny in her attempt to impose the temporary cap on skilled non-European emigrants. The judges’ decision is in relation to the current cap of 24,100 for the period between June 2010 and April 2011. After this time, the government will announce a permanent cap on emigration.

This new cap currently affects skilled emigrants arriving on visas classed as Tier 1, in which emigrants are free to look around for jobs. It also limits Tier 2 visas in which the emigrants have specific job offers.

The judges said that the secretary of state made no secret of her intentions. There can be no doubt that she was attempting to sidestep provisions for Parliamentary scrutiny set up under provisions of the 1971 Emigration Act. Her attempts, for that reason alone, was unlawful.

The JCWI chief, Habib Rahman, has welcomed this new victory in the courts. He has urged the sectary of state to prioritize the welfare of people and the country over and above her desire to pander to tabloid headline writers.

However, the emigration minister, Damian Green, was not so happy with what the court had to say. In fact, he expressed his government’s disappointment at the ruling. Green said that they will do everything in their power to continue to prevent a rush of applications before their more permanent cap gets put in place.

The government can simply change the laws to suit their needs.

Easy peasy.
