Default waiting for permission!!

Sent off my application a month ago, after much contemplating. Mainly because my son's father needs to give permission for him to emigrate.
We have discussed our plans with him and he has yet to commit himself to agreeing us to go.
Because the visas take so long our agent advised us to apply and then get the afadavit from my ex saying that we could take the child out of the country. Initially he seemed to be swaying towards this, he knows the other option would be us fighting it out in court.
We have now given him a deadline- this weekend- to tell us yes or no.
I am worrying that he will not agree and that the whole court process could take so long.
Apparently when immigration want the document we only have 50 days to submit it. What if the courts are taking ages to give dates? I hope it does not come to this but it could turn awful for us. Especially as they seem to be processing a lot quicker now.
I must be the only person that is hoping my application isn't going anywhere fast !!

Sorry for the rambling, but only 2 people know we are hoping to emigrate so I can't tell anyone my problems!!
