Visa Time Limit
Hi, just want to check how long you have from when your PR visa is issued until you enter Australia as I'm worried about selling my house. If I have not sold my house can I enter and leave Australia as often as I like on my PR visa? Thanks Andy

2. Your visa is valid for 5 years from grant (with a multiple re-entry facility), however you'll face hassle if you don't clock up 2 years in Australia during the first 5 years. Do the maths and you'll see you need to make the move proper within 3 years.

My visa runs out May 2006 and I plan to go out in July 05. If I don't have any plans to return to UK for a few years and get my citizenship there shouldn't be a problem should there? (Bear in mind all my family are in Oz so no reason to have to dash back to UK). My husband does have an elderly mother here though but if there were compassionate reasons and we had bought a house in Oz, kids in school, thereby shown commitment to the country surely they'd grant him a temporary RRV?

It's possible to get a 5 year RRV without meeting the 2 year residence rule if you can show 'substantial ties' to Australia - this is a lot easier if you are *living* in Australia.
Or, in the worst case situation, a 3 month RRV can be obtained if there is an urgent need to travel before becoming entitled to a 5 year one.
All this is explained on form 968i.
However, the point I was making is that those who want a simple life and not need to have to go through complex scenarios like this should make a point of clocking up the 2 years in the first 5, then an RRV is available on a no-questions-asked basis. Of course, taking citizenship makes life even simpler.

Thanks Jeremy. Everyone's situation is different and our timings have been influenced by not wanting to interrupt schooling for our eldest. We are coming as soon as he has sat his A levels this summer.

Can I ask we are going STNI so get instant PR but do we have to stay in Oz for 2 years continuosly to be able to apply for citizenship? are we allowed to leave the country for holidays?

They look for a total of 730 days physically in Australia as a PR during the 5 year period before you apply, including 365 days in the 2 years just beforehand.
Time periods do not have to be continuous but by the same token, if you leave for a few weeks holiday you have to exclude this time when you work out when you are eligible for citizenship. There's an excellent online residence calculator at the citizenship website for doing this.
