Urgent please Help!! spouse visa worries
my partner is going to work in OZ on the 457 temp visa and i was going with her as a 'de facto spouse'. However we may have hit a snag as we have only been living with each other for 10 months, we have been partners for 3+ years.
We have a joint bank account, bills, tenancy agreement, etc, but fall short on the living together for 12 month - which i believe in the minimum to qualify as de facto, can any one confirm this please.
thanks
Phil

Re: Urgent please Help!! spouse visa worries
Two things spring to mind when I read your post.
1. A defacto spouse visa & being the defacto of a 457 visa holder are not the same I dont think. Im not sure if the 12 month rule applies or not.
2. If it does apply, just because you don't live together doesnt mean that you dont have a relationship. I asked once if the qualifying period was measured from when you started living together or when you started the relationship, but didnt get an answer. Hopefully someone can answer that as it changes things alot.
Sorry I have no answers for you (only more questions!), but good luck .
