Basically, after three weeks of debating it, they are still no closer to passing - or not passing it.

I don't know what make you say this. It has more or less finished its passage through the House of Representatives.

Dear All,
I hope this finds everyone well.
Sorry if my questions seem daft but i am at the process of looking at different visa's etc.
I had kind of settled on trying to apply for a skilled independant visa (class BN,subclass 136) or a 137.
Does anyone Know how long this type of visa lasts for? and when it expires, do i then just apply for a Permanent residency visa ( ofcourse if i meet the criteria that is.Anyone Know what the criteria is for a Permanent residency visa?)
if i am lucky enough to gain either of these visa,s.How do i gain a Permanent Residency Visa? and here comes another daft question, does the Permanent Residency visa last for a certain length of time? or is it as it says on the tin, Permanent?

May i thank those who respond in advance for their kind help.

Please start a new thread with questions like this. You will get more answers if you post immigration questions on the immigration forum!!

136 and 137 are both permanent visas. You can find out more about the validity limits if you download and read form 968i.

I had a 'Google Alert' on 'Australian Citizenship' and it popped up on my e-mail yesterday, just thought people may be interested in reading the article????

So what does "It has more or less finished its passage through the House of Representatives." mean? Has it been passed?

hi does this mean if it gets passed to 4 years that if you have not lived in oz for 4 years your PR visa will get cancelled. We have just got our 139 bq sub class visa and have till june 07 to valadate. Can anyone tell me when do we have to be living there by as we have not sold house yet.

It has finished its debate in committee and needs a final vote before clearing the House.

Rather than relying on hearsay, why not look at http://www.aph.gov.au and find out these things for yourself?

regarding new citizenship rules - my husband, son and i are all british citizens (at the moment) we are looking to become australian citizens as soon as we can, which under current jurisdiction will be in 18 months time - as i understand it this will not change as we were granted residency in december last year on a 139 des area sponsored - however my question is this
i heard along the grapevine that children born after 1980 something, do not automatically obtain dual citizenship alongside their parents anymore ie. my son would not be allowed to live in either country if he so wished when he was older (he is 14 now) i would hate to think he wouldnt be able to return to australia or live in britain for that matter
am i right in assuming as australian citizens, we can still keep our british passports therefore utilising the best of both countries? and does this rule apply to my son also? can you please clarify as i am somewhat confused!!!!

Another little question for Jeremy, if he'd be so good:

When we obtain dual citzenship, I would assume that our PR visa in our UK passport will be revoked. Does this mean that we *have* to use Australian passports to leave Oz or could we go out on the UK ones and return using our new Oz ones? Purely theoretical since we have no intention of upsetting the various applecarts!

just pulled this from the DIMIA website : www.immi.gov.au

On 2 November 2006, the Australian Government tabled amendments to the Australian Citizenship Bill 2005 for consideration by Parliament.

The amendments include changes to the residence requirements for Australian citizenship announced by the Parliamentary Secretary to the Minister for Immigration and Multicultural Affairs, Andrew Robb, on 17 September 2006.

The new residential requirements will not apply to people who become permanent residents before the new Act commences. They will only be required to the meet the current two-year residential qualifying period provided they apply for citizenship within three years of commencement of the new Act.

Consideration by the Parliament of the changes to citizenship legislation currently before it is not now expected to be completed until at least the Autumn Sittings in 2007. Accordingly it is not expected that the new Act will come into effect before 1 July 2007.




At what stage of the process are you officially classed as a permanent resident?

Once you get citizenship you must use an Aussie passport to enter and leave Australia - beware, cos you need to leave enough time to get the passport, so don't book an trip abroad leaving the next day!

I'm told there's usually a great rush from the ceremony hall around the corner to the passport office!

Ahh, the above excerpt from the post of john_w raises the million dollar question again. That theme runs right through this thread. Is it when you are granted your PRV, when you activate it or when you move to Australia permanently? No one seems to have a definitive answer yet, but I'll stick my neck out and guess it's when the visa is activated. No doubt that will elicit further comment........

Obviously you don't start clocking up the days and months of residence towards your citizenship whilst you are not there!

As I have said before, the definition of "permanent resident" in the Citizenship Act is not the same as in the Migration Act and is very complex. My feeling is that a granted PR visa will be enough for exemption, but there is no guarantee that DIMA will take the same view.

In any case it's important to remember that the concession for existing permanent residents only applies for THREE years from Commencement Day. So if you cannot clock up the two years in that period and apply for citizenship before the deadline, you will have to wait four years anyway.
