UK divorce whilst in Australia
Hello All,
I am in the unfortunate position of wanting a divorce from my wife who lives in London. We have been seperated for almost two years and during this time have lived apart, I in Melbourne and she in London. She wants a settlement which I cannot afford(no kids fortunatly) and refuses to sign any papers I send her through the family law courts here in Oz. I know I can wait 5 years and have the marriage declared over but dont want that kind of baggage around my neck for that period of time.
Has anyone else been in this situation and what did you end up doing ?
Any advice would be greatly appreciated,
cheers

Probably best to have a discussion with a family law practitioner in Melbourne - immediately.

I'd used them when I went through this delightful experience and were very helpful for advice (albeit I was in the UK then)
Good luck.

As you aware aware a divorce based on 2 years separation does need consent. If you wait 5 years she will still be able to make a claim (if one exists) as you still have to serve divorce papers on her.
It is obviously more indepth than this.
