You might need to rephrase that.

I think it's a mistake if they decide to upgrade the charges to murder. I'm not well educated on law but could this decision result in his defence arguing he is being targeted to make an example out of him resulting in a sympathetic sentencing if found guilty of the lesser charge or manslaughter? Or have I watched far too many Mafia movies?

Also, I don't have any faith in petitions. Politicians will tell you that your avenue for getting your voice heard is through speaking with your local representative and voting. Petitions, to me seem to hold as much weight as a friends count on Facebook. Not trying to discourage anyone from signing it. Just sharing my view.
