Default Tax question..

Were moving to Oz on the 136 visa in 3 weeks . My wife currently works as a software developer and they have decided to keep her on and she will work from home in Australia. From (the companies) previous experience they feel the best way forward is to keep her pay as it is now, paid into her account here in Ireland. If all goes well they will fully transfer her over to the Melbourne office after a period of 1 year.

Does anyone have any idea how she will fare out tax wise? Obviously she will pay her tax here in Ireland and I see Australia have a tax treaty with Ireland (http://www.ato.gov.au/large/content.....htm&page=1&H1) and so we are wondering will this cover her situation? Any help would be much appreciated.

Also does anyone have an email address for the tax office in Australia? Cannot find it on their website.

You could always call them - +61 2 6216 1111, fax them +61 2 6216 2830, or write to them at GPO Box 9990, in the capital city of your state/territory.

Why would she obviously pay tax in Ireland?

Might be better for her to invoice her employers who would then pay her gross. She'd then declare it as income in Australia and pay Australian tax on it.

Much simpler than having to claim back tax paid overseas.

The ATO will reply to any questions with the same info as listed on their website. I don't know any details of the Australia / Ireland DTA, but this will be effective for your position. Genarally speaking if you wife is resident in Australia for more than 183 days she is resident here for tax (there are other criteria), however the DTA should allow for any tax paid in Ireland to be credited against her liability here in Australia. I would do two things, firstly check if your wife needs to pay tax in Ireland and secondly find a specialist accountant familiar with this type of situation.
I work / pay tax under a DTA between Australia and a foreign country and went through the process of trying to get answers from the ATO. I now use an accountant who specialises in this type of situation. Please be aware accountants such as H&R Block etc are normally not familiar with DTA's.
