Default Re: stni

Go to: www.immi.gov.au and select 'Sponsoring' from the list and it will give you all the details on STNI and ENS.

Remember STNI is only in Victoria, South Australia and Tasmania - does not apply in New South Wales or Queensland

Good luck !

State Nomination of Skilled Migrants

This fact sheet explains how the Government of South Australia, through Immigration South Australia, nominates skilled applicants to migrate to South Australia (SA) under two visa categories that have been established by the Department of Immigration and Multicultural and Indigenous Affairs (DIMIA).

These categories are:

§ The State/Territory Nominated Independent (STNI) (subclass 137) Scheme;

§ The Skill Matching Visa (subclass 134) (SMV).

These two categories are similar in nature, but have different charges and fee structures. They both rely on the ‘Skill Matching Data Base’ (SMD) that is assembled and maintained by DIMIA and contains the details of eligible migration applicants, their occupation and work experience and is provided to Immigration SA each month.

The Government of South Australia is keen to attract eligible migration applicants who are working in occupations that are in demand in our State. The Government of SA considers that by the nature of their skills and qualifications, these migrants can help the economic development and add to the cultural diversity of SA.

The STNI and the SMV categories are designed to meet the needs of business and industry in SA where employers are having difficulty finding skilled workers to fill positions from the local labour market. These arrangements are not intended to be used to fill vacancies that could be filled by South Australians.

In the case of STNI and SMV, the State Government of SA has a role in the selection and nomination of suitable migrants. DIMIA, is responsible for accepting and processing visa applications for permanent and temporary residence to Australia.

Eligibility

To be considered for nomination by Immigration SA, prospective migrants must lodge an application in one of these classes:

§ Skilled Independent Class BN (subclass 136); OR

§ Skill Matching Visa Class BR (subclass 134).

State Nominations are not points tested. However, all skilled Independent (136) applicants must have achieved a score equal to or greater than the ‘Pool’ mark and meet the threshold criteria in relation to Skills, Age and English language but not necessarily meet the current Independent category pass mark. These criteria include:

§ Be under 45 years of age at time of visa application

§ English Language skills

§ Nominate a skilled occupation, have their skills assessed by the relevant assessing authority as suitable for their nominated occupation, and have that occupation on the Employment Opportunities in SA List;

§ Recent work experience in a skilled occupation or have recently completed an Australian qualification;

§ If nominated, willing to migrate to and live in SA for at least two years.

SMV applicants nominated by a State or Territory are required to have “vocational English. However, if nominated by SA, which has established arrangements for an English-language upgrade course, an applicant may qualify if they achieve an average band score of 4.5 on the four components of the IELTS test, and are prepared to pay a fee to upgrade their English Skills to “vocational level after arrival in SA.

If you wish to know more about the English-language upgrade course, you should contact:

Employment Opportunities in SA List

Immigration SA identified those skills, trades, occupations or professions that have positive employment opportunities, both at present and in the foreseeable future, for SA.

This list is compiled using information from sources that include the Commonwealth Department of Employment and Workplace Relations as well as employment/recruitment consultants and job vacancies advertised in the press.

Our Fact Sheet on “Employment Opportunities in SA is available on the website.

Process for Nomination

Immigration SA searches the SMD every month to find the people who have the appropriate skills, qualifications and experience to match the current Employment Opportunities In SA List.

These people will be contacted and asked to complete a Questionnaire to determine if they meet the criteria for State Nomination plus additional requirements that include:

§ An assessment of their ability to settle in SA;

§ Their commitment to permanently live and work in SA.

Once SA has decided to nominate an applicant, the appropriate Form will be sent to DIMIA for their decision. From this point the process is administered by DIMIA and if a positive decision is made by DIMIA, the nominated applicant will be asked to successfully complete any outstanding issues such as health and character checks before being issued with a visa.

Nominations under the State Nomination Scheme are only considered if applicants’ skills/occupations are on the Employment Opportunities List in SA. Nomination does not provide a guarantee of a job. It is up to the person nominated to find employment in SA.

If you have already lodged an application with DIMIA:

To be eligible for selection for the STNI visa (subclass 137), applicants under the Independent category for migration must:

§ Complete Part I (Skill Matching section) of the General Skilled Migration application form (Form 47SK). This section records information about qualifications and employment history and is included on the SMD.

§ Be assessed and have achieved a score equal to or greater than the ‘Pool’ mark, reflecting the fact that applicants have met the threshold criteria relating to skill, age and language.

SMV applicants initially do not pay an application fee to apply and are not tested against the points test. However, if they are successfully nominated under the STNI Scheme, they will still need to meet the eligibility criteria stated above and pay the appropriate application fee to DIMIA prior to the granting of the visa.

If you have not lodged any application with DIMIA

You can still be considered for nomination by SA provided you meet the following criteria:

§ Meet the threshold criteria for migration; and

§ Have your skills assessed by the relevant assessing authority as suitable for your nominated occupation; and

§ That occupation must be listed on the Employment Opportunities in SA List; and

§ Must migrate to SA and live in SA for at least two years; and

§ Be nominated by the Government of SA and have that nomination approved by DIMIA; and

§ Apply for migration and meet the visa requirements set out by DIMIA.

Your next step is to contact Immigration SA, providing details of your occupation and contact details.

If you think you are eligible for State nomination, contact Immigration South Australia for more information:
