Default Statutory Declaration - is it a valid Stat Dec

A friend of ours has just got a solicitor to sign a statement he wrote for my husband's spouse visa application.

He just put his name, address, date of birth, occupation and how, when and why he knows hubby and I and what he thinks about our relationship.

He signed and dated it in front of the solicitor who then stamped and signed it.

The problem is that the solicitor said it was missing some wording that is usually on a UK Stat Dec.

Do you think Immi will accept this? He can go back and have the wording put on, but I don't want to inconvience him if it is not necessary. This friend is not an Australian Citizen, but we have two other australian friends who have done Stat Decs (they printed off a sample Australian Stat Dec form off the net - so theirs should have the correct legal wording on it).

Hi Eel

I believe the words "statutory declaration" have to be at the top of the page and the statement :

I <<full name here>> of <<< address here >>> do solemnly and sincerely swear the following statement is true and correct,

if the solicitor says it is missing something I would consider having it re-done to avoid delays, the above is the wording we used for our non-Australian stat decs.

hope this helps

Here's a legal version, can't argue with the supreme court.

Although not technically a legal statutory declaration DIMIA seem to make some allowances in these matters.

PaulDClark the wording and allowed witnesses vary from country to country. Even within Australia there is a small variation between states on who can witness a stat dec.

I'm led to understand that Stat Decs are quite common in Aus, much more so that they are in the UK, so I guess a lot of variation and leeway is to be expected.

My neighbour is a Justice of the Peace, so I got him to do mine. He says is is doing loads of certified copies at the moment as well for many people heading to Aus.
