Default Solicitors and step children

Hi
I'm hoping for some info about taking step children out of the country.
I was initially given wrong info from immigration with regards to this and i now have to go through a solicitor to resolve the matter.
The solicitor has said that we need a specific issues order or failing this a consent order.
The first can be dealt with where we live whereas the second must go to court where my wife was divorced.( This would be very difficult as she would have to get 5 kids to the other end of the country and 4 of them are 4 or younger.)

We have been advised that it would be best if I was to go to Australia first to get a job, find somewhere to live and get information on the schools in the area where we want to live so that we can show the courts that my step son has somewhere secure to go to. (This is not something I have seen mentioned on this site but 3 different solicitors have recommended it.)

My wife has tried to get an answer out of him as to what is the difference is but she couldn't understand him.(LOL!! her words)
I'm going along to the next meeting but as its 2 weeks away I was hoping someone here might be able to shed some light on these 2 terms.
We need to know if either one is a viable option before i book a flight to Oz as we dont want to spend anymore money than we have to as its costing enough as it is.

Any info greatly appreciated

Sorry haven't got an answer for you Mark - just wanted to say hope it works out for you.
I don't suppose you have any chance of getting your stepsons father to change his mind and sign the forms?

I have no idea whether in legal terms you would be better heading off to australia on your own but i would have thought that this was a very poor idea in personal terms. I can't see how being at the other side of the world from your family is going to make your kids feel more secure.

Hi Mark,

since I've been a member of BE, I've read the stories of quite a few people with the same problem. None of them have mentioned the above "solution"!

Anyway, the two most recent ones who've gone through this were "debbiemc" and "katsmajic".

Is the solicitor an accredited specialist in family law?

Sorry to hear it is such a struggle, we are taking my 2 step daughters, all we needed was a letter from their natural mother to say this was not a problem. Hope it all works out.

I'm not looking forward to leaving my family at all. My youngest is just over 2 months old so will not even know how I am and the next one is just over 2 who hopefully might still remember me.
I'm only doing because we think the move is the best thing for the family
and I'm not letting her ex beat me on this.

He is a specialist in family law and is also consulting with senior partner who charges even more per hour.(LOL!!)
