Default Rolling rental agreements QLD

Does anyone know whether you can go on a month to month rental agreement in Queensland? We've been in our unit for 18 months but ideally don't want to sign up for another 6 or 12 months. Agent has told us month to month is not an option but we know you can do this in NSW - are they right or just looking for the best deal for the owner??

They are available. However they are optional (like everything) for the owner. It may also be that the agent/company don't include them in their contracts. If I were an owner I wouldn't offer month to month either. It's personal preference I guess.

What do you mean by "they are optional"? If a new lease is not signed and no party has given notice then the rolling lease kicks in, no?

Not where I rent, lease ends, new one negotiated or I leave. I don't just get to go on a rolling lease if I choose not to sign the new lease. I suppose if a new lease isn't offered it may become a rolling lease, not sure.

Hope the OP works it out.

My rental agreement is a 15month fixed term, but it still requires either us or the letting agent to give notice to end it otherwise it goes on to a rolling contract.

Once on the rolling contract either party can give 2 months notice of ending the agreement.

I believe these are standard rules written into law.

Yes, that's how I understand to work. They can't just kick you out.

Hi

We are in this situation. We have a 12 month lease which ends at the end of July. We are building our own house so didnt want to tie into another contract. We were offered to renew the lease to a 12 or 6 month lease or we were also offered to continue on a "periodical lease" - wasnt sure what this was - but did a goggle search and its basically a week by week or month by month . We live in Queensland! Good luck!!

Either a new lease is agreed and signed or notice must be given by either party. If nothing happens then rolling lease kicks in automatically.

A new lease can then be signed after that. Most agents try and do this before the lease expires.

Yep, you can negotiate much shorter periods e.g. a few months at a time. We've done that. They (agents and owners) obviously want longer leases, but will be negotiable.
