Thanks for yr response. Well, would you bloody believe it on Friday I agreed with my agent we would leave the carpet, lights and curtain poles. Our agent also agreed to purchase the dishwasher and freezer for them. He asked about the sheds (we have 4 large ones incl a workshop) which we want a £1000 for they cost over £4k. We have had friends work colleagues etc who will pay that price individually to that figure so of course any money for us is more dollars for oz! Anyway spoke to the solicitor first thing in anticipation of completion this morning and lo and behold they have received a ltr from their solicitor stating that we will revert to our original fixtures and fittings (we didnt agree to that) plus leave the dishwasher, freezer and sheds. I had a long drawn out conversation after numerous on Friday with the agent I stated categorically that we would not leave the sheds. To which he agreed. Furthermore, i agreed with him that due to the continual wrangling etc the international shippers dates have been pushed out and we are unable to complete on aug 26th. We are now looking at 9th sept as we are on holiday for a week and thats it now. I stated that Im not prepared to pay a deposit as this is the 3rd bloody time we have sold and until we exchange nothing is certain again he agreed......... Now Ive got this bloody letter.....Im furious also my solicitor is in a meeting until lunch and they close 1-2 so no chance of speaking to him. furthermore my agent is out on appointments and his sidekick doesnt know what is happening. Ive asked them to chase and to call me back but ive been waiting since 11am so starting to get a bit frazzled now. Lets hope I get some good news this afternoon! :scared: Anyway rich and I made the decision if its not sorted today then we will put the house back on the market or threaten the agents with that anyway! We're goin through the same process, a buyer offered full asking price then decided it was too much 4 weeks after taking it of the market. Try and explain the house is on the market £15k under the current value and £20k spent on new bathrooms, kitchen and total redec. I think things should change, something like when you make an offer and its accepted 5% deposit should be paid if they pull out you keep the money. I am sure if you promised the buyer something they would hold you too it why cant they stick to what they say grrrrrrrrr i need a :beer: :)

Ive just chased my agent again and his sidekick has just informed me that the first time buyer the air stewardess who was supposed to be back in the country on friday now wont be back until wednesday as she is in scotland!!! This just does not make sense and someone somewhere is telling porkies!! Im just about to call my solicitor now! :mad: Irene |

Im not joking if I were you, Id call the little b*tch's bluff. Tell your estate agent you've had it with her BS and the house is going back on the market. Ive done it before (and meant it) and it works WONDERS.

Well a few days after their survey, yes they decided that they now wanted to do a full structural and considering they couldn't offer us a bean more etc etc we had to reduce our price we were furious!! anyway enough of that rant we phoned the agent any problems no he has spoken to them and all is well good. Furthermore, their solicitor wrote to ours indicating that there were no problems. All set to exchange tomorrow 5/8. We went away for the weekend and returned on Monday to find a letter from their solicitor which stated that actually there were a few issues re survey ie boundary wall is hazardous (doesn't belong to us and they would know that on their survey!) and that the pipework to the boiler in loft is untidy!!!! Anyway due to these serious issues they are not asking for a reduction in price or remedial work (yeah what exactly do they plan to do?) but would proceed with the transaction if we would leave our bedroom furniture which is not fitted but very nice cost us £3.5k, garden accessories, sheds and workshop, carpets, curtains, lights, mirrors, white goods i.e freezer, dishwasher etc and a whole range of other bits literally taking the whole cake!!! As you can imagine we told them no in no uncertain terms that they could go away!! I wrote to the solicitor and told him that unless they exchanged we will put the house back on the market, we wont do remedial work or reduce the price or leave anything here. I would rather burn stuff now then let them have it. Obviously the agent knows we are off to oz so i think they think we are desperate. yes we are keen to go but they are not going to take advantage. Anyway the agent rang us and tried to imply that we were being unreasonable as we really wouldn't want to take those items to oz would we? we don't want to take some items true but I'm not telling those bloody snakes! other items yes. anyway i then phoned our solicitor and he told me that our agent was apparently against us as he is charge of the whole chain and our being resistive to their requests is damaging his possibility of obtain commission down the line. Rich then phoned the agent and he wasn't there! he spoke to his colleague and advised him of our decision and also said that if he is acting not neutrally and the deal falls flat we will take it further. yesterday the agent called me and acted as if he never received the msg...yeah right am i getting cynical in my old age? The phone was hot yesterday and i certainly was not backing down. Anyway after a lot of discussions we agreed that we would leave curtain poles, carpets, lights, freezer and dishwasher for £500 and the agent would reduce his fee by this much. The buyers think they've got one over on us but they haven't. The irony was that the agent said the buyers wanted it as it was before ie the poles, carpets and lights. they then came back and asked for the freezer and dishwasher which the agent will stump up for. He then came back and asked for the sheds and workshop and that we should leave them behind as a gesture of goodwill????? i ran out of that a long time ago!! Our workshop cost over £2k 18 months ago and I'm sure we can resell easily for £500 locally it is bigger than a garage. Our other sheds are also large and the children's is particularly sweet and I'm sure we will get a £100 for it. Anyway the long and short is any money in my pocket is more dollars for aus. Told him no and that if they wanted them they would have to pay for them. he never came back to me so i am expecting the phone to be hot again today. The only problem now is that both PSS and John mason who i have decided between are now getting really booked up for end of Aug which is our planned completion. i am not prepared to pay a deposit until we exchange and have told them so due to this being our 3rd transaction. Anyway please keep all your fingers and toes crossed that we can sort things out and then exchange!! the agent is hoping for Monday. I will believe it when it happens. If all goes well we will be off to oz in October hooray!! Sorry for the rant but for those of you in the process of selling, keep your cards close to your chest and don't give in even when you are desperate to go. At the end of the day we would have relented to secure the deal but played hard ball and it worked, I'm sure for some it may not have done. Good luck to all of you in the housing nightmare! Thanks for all of your kind words, pms and karma it is much much appreciated. I didnt post last night because to be quite honest I felt sick and went to bed at 8pm. :( Basically I called my solicitor and told him the situation he said that he thought our agent was playing mind games with us and is mudding the waters. I told him that I just want to get the exchange done so I can move on we have been trying to sell our house since last July and I just cant take it anymore. These people are weasels and they are trying to play on the fact that we emigrating bastards!!!! Anyway told him the whole scenario and he said he would ring me later. He eventually called me at 530pm as you can imagine I was completely frazzled by then as I had hoped to exchange by 10am! He said that the buyers had now agreed to the fixtures and fittings which the agent will pay for and we relented and have agreed to give them our blue shed which is old and will be pretty damn rotten by the time they get there bloody hands on it!! prawns on the bearers i think??? He also said that he explained about the timescales re shipping and they were agreeable about 9th sept, and that if we dont exchange soon it may be pushed out till the following week. Which we agreed to. I asked him if he could phone my agent the details as we do not want to enter into any more conversations with him! :( He agreed and said let him deal with it now we have endured above and beyond, our buyers have tested our limits etc. I also said if we dont exchange very soon we will put our house back on the market and i wont sell it to them at all. He phoned the agent, and then called me back. He said that the agent is still very much anti us as if we are being uncooperative. he reminded him that we are in fact the only person ready in the chain :mad: He told him to leave us alone and not to call us tonight as we had just about had a gutful today. He told me and rich to sit and have a drink and hopefully things would be resolved in the next few days as our buyer is very keen but is blatantly trying to push their luck and hoping we will cave in bastards!! Well rich and i sat in the garden about 6pm just trying to calm down when low and behold the phone rings.......yep you guessed it the f*****g agent! rich is now ready to rip his head off!! Basically the agent said that he feels that we should trust our buyers thats a laugh and book our shippers etc. we categorically told him that our solicitor has advised us not to do that and not to hand over any money until we exchange. there has been no goodwill from them and why should we put ourselves in a position where we start panicking no bloody way!! anyway there was quite a lot of argy bargy and rich called him a liar. he said what do you mean etc etc rich said well you said first time buyer was ready paid deposits etc and thats not true, he went quiet, then rich said you tried to ask our solictor to reinstate original fixtures and fittings list...again went quiet. Basically rich said that he had been biased towards our buyers and never once said that they were out of order etc etc. he then stated that he would apologise profusely if we felt that way etc usual dribble. Anyway long story and it would take all night...went on for 1/2 hour and agreed to disagree rich said he had extended his brief and to leave it to the solicitors. This morning i phoned the solicitors and told them that pss require a months notice for booking and that as today is the 9th we may lose that date. He said that our buyers are going on holiday for a fortnight the following week so may have to delay completion until after their holiday. I said i dont care i just want to exchange, if i get a couple of extra weeks in my own house all better for us!! :D Anyway first time buyer not likely to be available until tomorrow so hopefully it will happen then? Well I shall let you guys all know as soon as I do. In fact when it happens I will be thinking of having an open house so i can trash this house and use as many of the suggestions you kindly sent fraser for his bloody buyers. sorry again for another long rant but it just had to be done!! weve had no other news this afternoon so all quiet on the agent front...maybe he got the msg Irene |

Poor you...I really feel mad for you just reading this. Just a thought, if your buyer is a hostie, Im assuming she is not unattractive. Your estate agent probably fancies her, that's why he seems to be favouring her over you which is WRONG WRONG WRONG! :rolleyes:

Well its 12 oclock and still no news :mad: I have just rang my solictor and there is no news from anyone. He is going to try and chase up now.....im starting to wonder whether the house will go through today? I think if the next call from the solicitor is negative i may have to say to him to tell our buyers our house will go back on the market. dont really want to do that as we are so near and yet so far!!! :( Its time for a bit of chocolate I think before my next patient arrives!!
