NEWTS1 is an unknown quantity at this point

my husband hasnt done the tra yet, and we are wondering whether to,as when we apply for the visa do we have to declare that his son is currently serving a prison sentence, his son is 18 yrs and doesnt live with us,any information we would be gratefull for thanks sue.

Get some specialist advice. There is such a thing as "one fails, all fail" for health and character requirements where if one family member (whether included on application or not) fails the tests, the whole family's application is refused.

HOWEVER, children aged 18 or over are not automatically "family members" - it depends on circumstances. An online forum won't be able to help you much more than this.

So you need to find a good migration agent familiar with these issues. Be warned - many (if not most) agents are not. Ask on the immigration forum for recommendations.
