PR and want to claim super earned while on temp visa

Hi Guys,

I came across this info below for a week but unsure if I m qualified to claim it.

"However, Australian and New Zealand citizens and permanent Australian residents are able to claim super money they earned while previously in Australia on a temporary visa if this money is now held by the Tax Office."

I knew that as PR holder , we couldn't claim for super money till we retire. But I used to be work while i was a student visa and SIR visa holder before I got PR. In this case, if i decide to leave Australia , can I claim my super money ?

Anyone can shed light on my question ?

Once you get a permanent visa, whatever you've paid into super is locked in.

Thanks for your info but a friend of mine sent this info to me

This payment is not available for Australian permanent residents and citizens or New Zealand citizens (unless you previously visited Australia on an eligible temporary visa – in which case, some of your superannuation may still be payable as a DASP).

This condition above applied to my case. But I m not a 100% sure. I will find out. I m a bit confused.

Yesterday I went to ATO and have a chat with a lady at the customer service counter. She told me that I can claim super I earned while holding a temp visa once I depart Australia permanently. But I might double check with ATO super section again for clarification.

To be honest ...I m not sure if I can claim it.

Good question ... if you are PR/citizen can you withdraw superannuation paid while on an eligible temporary visa (before PR/citizenship).

The "Leaving permanently" would rule most out, other than that, see what the ATO say and be prepared to find a lawyer if they say no.

Hi Guys,

I called ATO super section last week for clarification.

I ve been told that I can claim the super money I earned while I was on temp visa in Australia if I decide to go back home for good.

I will claim it if i decide to go home for good.

Just be aware that if you can claim your super and do so - there will be a very large tax deduction. In other words, you will not get all of the super that was paid while you were on a temp visa.

Since the super earned since you got PR has to stay in Oz anyway, you will be better off leaving the super earned while on the temp visa in Oz as well.
