Passport Entitlement

Hi all,

Information required if anyone can help fill in the blanks for me. I am emigrating to Melbourne to marry my Australian fiance and I have a couple of questions

1. When married, will my fiance be entitled to a British passport and;

2. When we have kids are they entitled to a British passport even if they are born in Oz.

Grateful for any information.

Dale

No. Being married to a British citizen is not enough. You would have
to sponsor her to live in the UK and after 3 years residence she could
apply for naturalisation.

How did you get your British citizenship? If you were born or
naturalised in the UK, then any children you have born in Australia
will be British citizens by descent automatically. You should
register their births with the High Commission and get them British
passports, but it's not legally necessary.

Your children in this case will be British citizens by descent, which
will affect their ability to pass on British citizenship to their own
children (your grandchildren) if they are also born outside the UK and
its territories.

If you were not born or naturalised in the UK yourself, then things
might get a lot more complex.

I've put some notes together on the consequences of being British by
descent at:

If you've got any connections with Northern Ireland (or the Republic)
then you might have other citizenship options.
