Default partner becoming PR

I wonder if you can help, my fiancee is on Spouse permanent visa (subclass 801). She has had for 2 years. She can now apply for Perm. Residency. How do we go about this, what form do we fill in.

?? If she's on a spouse permanent visa she already has PR?

Do you mean citizenship??

Sorry, She is defacto partner sponsored temporary perm resident, she can now become full permenant resident.

I think what you mean is that they are a provisonal resident.....i could be wrong but I dont think there is such a thing as a temporary permanent resident!

For 2nd stage partner processing for the PR visa DIAC should contact you around 2 years from the date of the first application. If this time has passed a while back and you haven't heard from them then I suggest you give them a call.

As far as forms go....its like the 1st stage all over again.

Thanks. We will contact them when the 2 yaers is up (i think 2 weeks time) and start the process moving.

What you are saying makes no sense at all. An 801 visa is a permanent visa ...

Erm if you are on the defacto temp perm visa, then your processing office in Australia should get in touch with you, that is if you have kept them up to date on your address. I have been here since December 2005, and received a letter from the Brisbane office a few weeks back, requesting Oz police check and the further appplication with proof of our relationship. This is well before my full 2 years are up.

Subclass 801 is a Permanent visa, when she has been resident in Australia on this visa for two years then the next step is to apply for citizenship.

The spouse Temporary visa is a subclass 820, this one is temporary for two years and once them two years are up then she can apply for PR.

I think you need to clear up which one she's on....
