Does anyone know the implication of working for longer than 3 months with one employer on a working holiday visa.

I've just about reached the limit and am desparatley looking for a new job. In the mean time I'm wondering at the likelyhood of being picked up for going over the 3 months by 'a bit'.

DIMA take a dim view of breaching the conditions of the visas they grant (in
this case condition 8108). If they find you, your visa will be cancelled and you
risk detention/deportation. Plus, if you try to apply for any future Australian
visa, it will count heavily against you.

These recent cases give some guidance:

http://www.austlii.edu.au/au/cases/c...2000/2239.html

You can find others by searching the MRT and IRT archives (for 'condition 8108')
at: http://www.austlii.edu.au/au/cases/cth/IRTA/

Most people on this NG would consider that it's not worth the risk of breaking a
visa condition, leavig aside entirely the morality of so doing. Leave your
current job, take a bit of a holiday while you find another (as you're supposed
to do) and enjoy Australia without having the worry of something like this
hanging over you every day.

Depending on what you are doing, DIMA may grant you an extension. I was granted one
on the basis that I was 'uniquely skilled' in the company that I was working in (I'm
in IT). The tax system has a feed back to the DIMA's system, so they know what you
are doing!!!
