hi
We have applied for skilled independant visa, and initially we are moving to Adelaide to be near relatives. Then we got a phone call from mother in law saying an old family friend was home from Australia (Cairns). and would like to speak to us.
It turns out he could possibly help with jobs as he is pretty high up in a company which could employ my partner.
Do we have to stay in Adelaide for 2 years or can we move to the East coast???
thanks
kendra

Hi
You may want to post this on the immigration board as that is where most of the visa specialists are.
Are you on going on a STNI sponsored visa? if you are you are morally obligated to live in the state that is sponsoring you but as I said I am led to believe it is a "moral" not "legal" obligation so dont know what will happen to you if you decide to live and work outside the state that is sponsoring you.
Any ideas anyone?
Anyway we are going to Victoria sponsored by the government and will be living there for a minimum of 2 years
If you are getting a job why not go on the "Employer Nomination Scheme"
Check it out here:
Nominated by an employer?

If it's STNI you have an obligation to live in the sponsoring state for 2 years, if it's regular skilled independent (subclass 136) you can live anywhere in Australia you like.
The new SIR visa has more specific obligations.

Hi Jeremy thanks for the reply,
I was advising that it was only a "moral" not "legal" obligation.
Am I correct in advising they could still legally live anywhere and not be in danger of losing PR through getting their visa revoked or am I wrong?
I am just quoting previous threads and it is just my understanding, although it would still be extremely wrong to do this?

The obligation with STNI is a moral one, but the Government could easily legislate to change it into a legal one. It was done in 2001 for RSMS (and the legislation applied to all RSMS visas, not just those granted after a specific date).
If people abuse the STNI system this is a lot more likely to happen. Although part of the solution lies in the states exercising 'quality control' over whom they nominate and avoiding those they think are going to be footloose.
