RIGHT-WING extremist leader Jack van Tongeren used the internet to bypass Australia's tough anti-racism laws within a day of his release from prison.

The freed neo-nazi shielded himself from prosecution by operating the Australian Nationalists Movement's publishing and recruitment arms through a United States-based internet company.

The move puts his internet operations outside State and Commonwealth jurisdiction and under the protection of the First Amendment of the US Constitution, which guarantees freedom of speech.

The same tactic has been used by Germany's extreme neo-nazi groups to stymie that country's race-hate laws.

It is understood Mr van Tongeren plans to use the internet as the main weapon in his self-described anti-Asian war. And nothing can be done.

Attorney-General Jim McGinty conceded there would be "grave evidentiary difficulties" in proving where a crime was committed technically.

The group's website is hosted by a Utah-based company and is contained within the White Pride Coalition Australia site. It sits alongside tribute pages to Adolf Hitler and the Ku Klux Klan.
