Last Remaining Relative
 

HIYA ALL

When we leave the UK we will leave my brother behind, who will be last remaining relative in the UK. We have another brother in Asia who has lived there for 11years with his own family.

Can my brother in the UK get a last remaining relative visa? If so do i need to be in Australia over 2 years before he can apply? I have heard conflicting things about the time period for this.

Have you looked at DIMIA website?

Otherwise an agent may advise.
My youngest son will be a last remaining relative but I don't know how it works for brothers.

My sister brought her son over on a last remaining relative visa a few years back so I may be out of date, but as far as I know the person who needs the visa must be the last remaining relative in that category (eg child, sibling etc) outside Australia, so your brother may not be eligible if you have another brother in Asia.

I think you have to be in Australia for two years before you can sponsor someone (you need to sponsor a last remaining relative).

I'm no migration expert though - you probably need expert advice in this situation.

The main problem with this visa is even if you qualify it is a very long time to wait as they only issue a few each year. A friend of mine applied for her Mum to come out on it. She passed all the medicals etc. Then then told her she was on the waiting list and it takes 5 to 10 YEARS!

They are still waiting 3 years later. and when you finally get selected you have to have all the meds etc again, so by this time her MUm could have got too ill to leave anyway.

I don't want to put a downer on it, just be aware of this so apply early!

Tina - you are confusing the remaining relative visa with the (non-contributory) parent visa.

Parents cannot be sponsored as remaining relatives. And remaining relative does take a long time, but not nearly as long as non-contributory parent.

In answer to the original post, the brother in Asia will likely disqualify any remaining relative application unless it can be proved that he is permanently settled in the country concerned, *and* that there is no contact (in other words, estrangement).

Dawn - Have you thought about the Skilled Australian Sponsored or Skilled Designated Area Sponsored options instead?

I obtained such a visa as a brother. There is good info on the DIMIA website - and despite the fact that my agent said it could take 2 years it actually took 7 months.

to sponser a last remaining relative, i need to have PR visa. I've got the bog standard visa for skilled independent. Is that a PR visa, or do you get the PR visa after 2 years?

I looked on the Dima site, but i just don't see what i am looking for.

That sounds like a PR.You will need to be there 2 years before you can sponsor though.
You will also need 2 years tax records to stand as assurer.
