LAFHA under threat

Re: LAFHA under threat
Problem is, its not just 'highly paid foreign workers repeatedly receiving tax-free living-away-from-home allowances on top of their salary' is it, it also affects moderately paid foreign workers, in country autralians and Kiwis....so its not just a simple matter of a sweeping brush.

Looks like NSW is not sticking to the UN agreement

Possibly so, I would expect a limit of some sort may be imposed initially and then if it was to be looked at on a full cessation then it would be phased out gradually over a defined period to allow individuals and companies to make other arrangements.

Don't be so sure - this is, of course, the same government that is, as we speak, attempting to bring in tax changes that can be restrospectively applied, against the recommendations of the tax commission.
Because they are obsessed/hell bent on returning the coffers to surplus, don't assume that fairness will enter into it at any point.

LAFHA as we know it is finished.
"He said temporary residents will now only qualify for the allowance if they maintain a home in Australia from which they travel to other "fly in fly out" work, and workers will have to have documented evidence of their spending.
"No permanent resident legitimately using this tax exemption for accommodation and food expenses will lose any entitlements," Mr Swan said.
He said the crackdown would save $683.3 million over the next four years"

In practice, many people on longer stay visas are establishing homes and new lives in Australia. They no longer have a "usual place of residence" in another country.

I was in exactly that situation. I claimed LAFHA, you would be daft not to, but I can understand why my claiming it would have been considered a 'rort' by some.

Increased visa charges as well. Anybody would think they don't want people to come.

Re: LAFHA under threat
Seems like a logical reform to me. The LAFHA was intended to compensate an employee for expenses incurred when required to live away from their usual place of residence in order to perform the duties of employment.
In practice, many people on longer stay visas are establishing homes and new lives in Australia. They no longer have a "usual place of residence" in another country.

Re: LAFHA under threat
Most of the news articles I have read only mention 'Executives' using the LAFHA system - not general workers. I can't find a reference that suggests it's going for everybody.

Speaking as someone who emigrated with my family entirely at my own expense and received no special treatment once here, I am relieved that my (excessive) income tax will no longer be used to make your life easier!
