Default LAFHA related to contract or visa status???

Could someone please clarify whether entitlement to LAFHA is related to your employment status or your visa status. I have been offered a permanent contract but am being sponsored initially on a 457. I have been told I am not entitled to LAFHA as the contract is permanent.

Is this correct and if not can someone point me in the direction of something official looking that I can chuck at an employer please

Permanent contracts and temporary visas don't mix very well.

It's up to the employer - you can throw every official thing at them but it's not a compulsory entitlement and if you haven't got it agreed in your contract you will find it hard to change their minds about LAFHA.

For more information, do a search on this forum, LAFHA comes up regularly. Also, look at www.ato.gov.au for information issued by the ATO.

My OH is on a permanent contract and a 457 visa and got LAFHA. The issue is whether your employer wants to give it and your intention to stay.
