LAFHA allowance
 
Hi

Theoretical question.
Providing I manage to get it when being on 457 visa (currently intending to be there only temporary), would I then get any problems after say 2 year time if I decide to go for PR?
Wouldn't taxman try to recover money?
Or is it simply getting stopped when you lodge you PR apllication?

They won't try to recover it, it will stop.

I would also suggest you do not correspond in any way with your HR or payroll dept about going PR. I did and my HR dept didn’t allow me to claim LAFHA as they claimed that because I emailed them about a possible PR application my intention was now different although I haven’t actually applied for PR

an rightly so, you made it publicly known your intention to stay permantly and your HR did the legal thing.

Im not saying they are wrong!! Im just warning those who dont know what you say may have implications further down the line

But if somebody has intentions to stay they are not entitled to LAFHA.

yea but c'mon - HR did the right thing agreed. But its like me thinking I am going to rob a bank. I mean the intention is there but until I do it, that is irrelevant.

Noone in their right mind, after reading this thread would decide they are honor bound to put this forward - woudl they? perhaps I am just immoral?

One of the main reasons why it is not advised to formally communicate to HR is that in the event they are ever audited there would be the possible come back to them that they administered LAFHA with the knowledge that you intended to apply for PR.

All very subtle but with HR departments generally being conservative it is better to err on caution.
