Hey,thanks for that!! Couldn't find that info anywhere. Groan - still means not getting to oz until next year though,eh! I'll have the medical when they tell me to then and not soon incase it expires in validity quickly.

Really, do you have to wait until you're 3 years free of it until they give you the all clear?!?

Try posting the question in the Immigration forum and hopefully an agent might be able to answer it for you. It's worth a try anyway.

Not wanting to throw a spanner in the works here for the OP, but my mum had breast cancer and the all clear was due to be given after FIVE years.

Unfortunately for my poor mum she didn't get to the 5 years before it came back. She contracted secondary breast cancer at 4 years 8 months.

Yep, I totally agree. It is something that none of us can guess at as DIMA look at each case individually. We don't know the full prognosis for OP's case and we are not doctors so it would be totally out of order for us to give any advice as it will be pure guess work.

Sorry to read about our mum Wendy. As a medical means of statistical analysis Five years is the number quoted in relation to being deemed "clear" of cancer. It is only for statistics that this number is quoted.
The reality however, is that you are never cured of breast cancer until you die of something else! In that case I wonder if they'll ever let me in!!!!
I have posted the same enquiry on the Immigration forum as advised incase any professional agents can help me.

I honestly don't know the answers for you. All I know about breast cancer is that it's a bloody horrible disease, and I wouldn't wish it on my worst enemy.

I'm really sorry that you had to get it and I hope that you recover fully from it.

Thought you might like to see what I received back from the health Lawyer ( Peter Bollard )in Sydney who deals with cases like my own.

Dear Pearl,

There is no formal 5 year waiting period but the longer you go without further problems the better. If you ran into problems with health criteria on a permanent visa application you could consider apply for a Subclass 457 visa sponsored by an Australian employer .It is easier to pass the criteria in such cases if the employer gives an undertaking as to meeting any health costs that might be incurred. At a later date you could apply for pr again after a greater period without problems. However the risk is that the law might change while you are waiting to apply again.

we started process last september and now just waiting on medical clearance - should be may
i kept being told nurses are on short list but still turned out not v. fast process for perm, residency

just a point of good info i was told...do not send police checks in too soon as DIMIA gives you year to get in once visa issued BUT take the date from police check or medical date - which ever earliest
