How to Withdraw Super
 
Hi All

Need your input regarding how to Withdraw - Super. At the moment, I have valid work visa - 457 till Dec 2013 and I worked in Australia for more than one year. However, I have moved back to India as per my project requirement. Meanwhile, I received my PR last week but havent travelled to Australia since then.

So my question is, can I cancel my 457 and apply for Super - Withdraw before travelling back to Australia on PR?

If you have already received your PR, you don't have a 457 anymore. It supersedes your previous visa. I'm going to move this thread to the main Australia forum, as it doesn't really belong in the immigration section.

when you move out of Australia for good, you can withdraw your Super contributions by writing to them. It seems that you are moving back in, so if you want to start your PR from lying to the government, go ahead.

Yes, if you have left Australia you need to apply for a DASP

As mentioned though, you have to make sure your 457 is cancelled by requesting to do so with Aus Department of Immigration and Citizenship.

Once 457 is cancelled, they will contact your Super provider who in turn will organise the pay out.

If the OP has been granted PR, he no longer has a 457. The 457 will have been replaced by the PR visa.

And as I understand it he will not get a Super refund now unless he can prove that the PR visa has been cancelled.

I would imagine so, but I was just pointing out to the previous poster that DIAC doesn't need to be informed about the cancellation of the 457, as it will have been superseded by the PR. You're right though, he'd need to deal with the PR.

I do wonder though, why on earth the OP decided to apply for PR if he's not intending to live there. Particularly to the extent of withdrawing his Super. :confused:

I'm leaving Oz for good after being a PR for 11 years & can not get my Super refunded or transfered to a UK fund. They say it has to be left in the fund, in Oz until retirement age.

That would probably be because unless you actively cancel the PR visa (is that even possible? :unsure:), you status of permanent resident means you could return and live in Australia in future. From what I understand (mostly from reading BE :o) you can only withdraw your super if you can show that you do not intend to return and so do not hold a visa/passport allowing you to do so.

This is what the DIAC informed me when I tried to cancel my PR visa to withdraw my super:

As you hold a valid Permanent Residence Class visa you are currently not eligible for a Confirmation of Immigration Status Certification for the Departing Australia Superannuation Payment. You may however, apply for the Confirmation of Immigration Status once your permanent visa ceases on 09/02/2014.

I take this to mean that if I apply for the Confirmation of immigration status once my PR expires and inform them that I do not wish to return to live that I would then be eligible for the Departing Austalia Superannuation Payment??

Well over the years a few people in the UK forum have discussed this and announced their intentions to claim their Super, but no-one has yet reported back on whether they have been successful! Give it a try and if it works please report back with the answer as its a common question and a confirmation would be great!

I don't think so, not if the contributions were made whilst you were a PR is my understanding. I would not expect DIAC staff to be qualified to comment on matters around super, they are not that reliable on matters around immigration.

The only one I can recall was (I think) TraceyW and she went through hell and back. I thought the Departing Australia payment only referred to the voluntary component (i.e., over and above 9%) but I might be dreaming that.

Mrs TB is the CPA, I'll ask her later.

Yep, thats the one I remember, though I know a few others planned to do it. Gave up trying to find the links on the iphone!!
