Help! about to go unconditional on a house, but theres no Final!
 

we are just about to buy a 18 yr old Queenslander, that needs a bit of tlc.
But theres no final (pass from the council), from when it was built.
Has anyone had this problem?
We are abit concerned about resale etc.
arh what do we do? the solicitor reckons this is not un normal around here, but, what do we know.

What do you do ? You need to ask your solicitor for a better answer, or get a new solicitor - just my opinion.

If I were you, I would also phone the local council and get a better understanding of this issue. Also phone a couple of insurers and ask them if this missing approval might invalidate any future insurance claims....would be a touch frustrating if your new house burnt to the ground and your insurance company refused to pay out.

IME most houses back then wont even have council records. We have a couple of older houses rented out, no council records exist, it is pretty general knowledge that would be the case.

However if your not happy about it.... But did you put a clause in the contract that a final certificate was required?

Check with your local council if they generally hold 18 year old records for houses in that area, or were 'finals' even done then.

You could try getting out of paying rates though. Sorry council, you say you have no record of the house, you can't therefore charge us rates. ;)

after a long day, never off the phone, we have pulled out.
The insurance was the main problem, apart from the resale.
i,ve lost money and i,m a bit gutted but it seems that if a house has never been final council approved it can affect an insurance claim.
