Guidance please
Hi
Got TRA acceptance a year ago but due to parents failing health had to put process on hold.We are wanting to resurrect our application now and apply for our visas but one thing is bothering us and we wonder if any of you fantastic,helpful users on this board can guide us!Our eldest is now 16 and has just been accepted into a top class sixth form college,which we are glad of and are willing to wait until he completes the 2 year course before emigrating.Obviously we will validate and return to the UK.However,when he finishes 6th form,he will be over 18.Will he still be able to come with us or do the rules change? Any help much appreciated.Thanks |

We were told by our agent that a sixteen year old in full time education, and still living with their parents, should be no problem when applying for a visa, as they are classed as emotionally and financially dependent upon you. So if you are about to apply for the visa you should have no probs. However if you wait and apply for the visa when your son is 18 things are a lot more complicated. You would then have to prove (through documentation etc) that your son is and has been totally financially dep on you, and that he has lived at home continuously since leaving school at sixteen. I think I have all this right, but to be on the safe side it may be worth having a word with an agent or two, I'm sure they would discuss this on the phone with you.

Any help much appreciated.Thanks 1. Dependency can become a problem to prove once a child turns 18 before the application is *decided* 2. As long as your son remains dependent up to the point your visas are validated, it doesn't matter what happens after that (at least for the initial migrant 5 year visa - if he stays overseas until his early 20s and then can't get a resident return visa he'll be in a mess).
