End of tenancy question
 

I was wondering if it was the norm or possible to do a month to month lease at the end of a tenancy? We are trying to find the next rental here in Brisbane but in case we don't find what we are looking for we were wondering if this was an option. We like our current rental but don't want to commit to another long term lease.

what you looking for? we are looking to break a lease on a 4 bed with pool in The Gap at the end of the month.

We had a 6 month lease and extended it month by month- it cost us an extra $50 per week to do so, but we only took 2 months to finish buying a property.

We went on to a month by month lease after our first year, and carried on that way until we wanted to leave, it was perfect as we were building and did not know when the house would be ready.

Thanks so much. As my husband has been an IT contractor we can't qualify for a mortgage just yet so we have to rent for a bit longer but really don't want to stay in our current house any longer than we have to but don't want to be forced into moving to somewhere less than ideal if crunched for time.

I think it is just up to the landlord usually. Some will, some won't depending on supply/demand etc...

My landlord was happy to do that, then the rental agent talked him out of it. Grrrrr.

We took an 18 month fixed term tenancy and have been on a rolling tenancy since that ended, a further 18 months now. At the end of our fixed term we asked for the contract to be made rolling, the agent told us that the landlord didn't feel comfortable with that. Therefore we made sure we were seen viewing other rental properties in the area and didn't re-contact the agent. Strangely enough it all went quiet....and we've been here ever since.
My suspicion is that the landlord is very happy for us to stay, it is the agent that often pushes for a renewal of contract as he gets to charge fees to both parties. If the landlord is happy with you as a tenant what have they got to lose? If you move out as a result of refusing to commit to a new contract then they will have an empty period, any repairs to do, inspection and new contract fees from the agent. This is then followed by a new tenant who is an unknown quantity........my advice would be to stand your ground and see if they issue you with notice to leave.

I believe the landlord has to give you two months notice regardless of whether you're under lease or not. You have to give 1 month. Makes sense. They would have a way around that though as they only need to give you 1 months notice of a rent increase which they could make set to whatever they want. Could be too much for some and so have to move out.

Agree some LL want the security - we had to break ours much to our annoyance of telling them repeatedly we want a month to month before we signed a new agreeemnt.... the only other thing you can do is not sign a new long term lease then go down the road of sending them notices to get you out - wont be a problem if you think you are going to be out in a few months anyway. If you are paying on time its hard to justify any eviction if you have a paying tenant - the risk for the landlord is trashing the place, having to get someone new - etc etc....

Thanks everyone. Unfortunately our landlord is being difficult and won't agree to anything less than 12 months. He is going to be in for a shock as rents in my area have come down dramatically and he won't get anything near what we are paying or may take ages to find someone that will pay what we have.

We have found a house we like but it isn't available until 2 weeks after our lease ends so we need to figure something out.

Just keep paying rent. He'll have to give you 2 months notice
