I need consent from my ex to move my child to oz. We were never married & he has agreed OK. The problem I have is that we turned up at the solicitors who agreed to witness it & they just refused when we got there. said they couldnt possibly witness until the father had had proper legal advice. The father even said this is crazy, its ok I know what i'm signing & they still said no sorry. you both need get solicitors & sort it out through your solicitors. Neither of us want that.
How do we get round this? I've applied and been accepted as long as we get this stat dec back to oz within next 3/4 weeks else application expires, so am quite desperate to sort this out.

have you tried another solicitor my partner had to get her ex husband to sign a stat dec, we typed it all up and he signed it in front of the solicitor there was no problem,best of luck

Hi i am in scotland and scottish law means you do not have to seek consent from ex partner if you were never married. To be on safe side i asked my ex to write a letter anyway and sign it stating he did not object. Dimia accepted this and we did not have to use a lawyer at all or do a stat dec. Do you reside in england or Scotland.

Try another solicitor. My husband and I had to get our Ex`s to sign sats, I typed up the Declaration and we took it in the solictors to get it signed. No problem go somewhere else.
