Cool Christmas and Public Holidays

With Christmas Day/Boxing Day falling on a Sat/Sun this year, we have been given the Mon/Tue off as well.

Mr PP has been told at his company that Mon/Tue are normal days and are not public holidays - does anyone know any different to this?

Unless you live in Norfolk island the Monday and Tuesday are both a public holiday covering An extra day for Christmas (the Saturday is also a public holiday) and Boxing Day which looking at these website actually always moved if it falls on a weekend or Monday

Thanks for the link, I shall call the number on there tomorrow - it deffo says Mon/Tue as public holiday but husbands boss is saying it doesnt apply to them so Ill give them a call.

On the calendar we have at work it says that they aren't a public holiday for NSW, but we have been told by our boss that they are...........maybe his boss is looking at a calendar and going by that........

You might want to check his contract first. In mining for example there is no such thing as a public holiday. This year i will be off over chritmas and new year but only by using annual leave. Some other industries / jobs are the same

In Victoria, we have Monday as a public holiday for Boxing Day, Christmas Day falling on a Saturday is not deemed a Public Holiday.

Each state apparently has its own legislation regarding Public Holidays

I just found a website that says: The next Public Holiday, Victoria will celebrate is Christmas Day - Monday 25 December. followed by Boxing Day - Sunday 26 December

Only in Melbourne.......

Most States quote:
Christmas Day:
Saturday, 25 December and Tuesday, 28 December
Boxing Day:
Monday, 27 December

but VIC shows:

Monday 27 December substituted for Saturday 25 December.
Boxing Day

It may be that the person just doesn't know, and until they receive something official, they will go with a standard line.

As far as I am aware, Public Holiday status cannot be removed.

The Act, up until recently created this situation (in QLD):
Without an amendment to the Act, workers working on Saturday 25
December 2010 and Saturday 1 January 2011 would receive only their
usual Saturday payment for the day and would not have the right of refusal
to work on the day.
These are quotes from the recent QLD Holidays Amendment Bill 2010.
In respect of the other State and Territory jurisdictions:
• for Christmas Day 2010, New South Wales (NSW) and Western
Australia (WA) have arrangements in place maintaining a public
holiday on 25 December as well as appointing an additional day on 27
December (WA – by standing legislation) or 28 December (NSW – by
special proclamation). All other jurisdictions have standing legislative
arrangements to substitute Monday 27 December as the public
holiday for Christmas Day.
Not sure when this came into force, but there was a speech in Parliament about it on 10 October 2010.

I think that might not be illegal, by law I believe they are supposed to count both days as public holidays, and if you work those days you are supposed to get extra holiday pay. If you work on the Saturday plus those two days you should get holiday pay for all three days. (Heard this on the radio a few days ago).
