Child migration
Hi wondered if any of you can help. I am about to apply to migrate to Austrailia and have two children from a previous marriage. My ex husband has agreed to let them migrate, however I was wondering if anyone knew what documents I require to send in with the main visa application? It states in booklet 6, a statutory declaration is required - does anyone know if this is a court order giving custody or a letter from a solicitor stating my husband has agreed for this. Any advice would be most helpful. Thanks

It's a declaration your husband needs to make in front of a solicitor. Unfortunately there is no standard wording (or form) as it's done under local law but DIMIA look for words like 'consent', 'move', 'reside', 'permanently' and 'Australia'.
Others who have gone through the process and got visas in similar circumstances may be able to help.
Court orders are only required if a parent with parental rights refuses to consent any other way.

Thanks Jeremy, that is really good information. I need to speak with my husband and arrange to have this done.
