Brightstars - cancelling contract and consequences
 
Hi all,

My son signed up for acting classes with Brightstars ealier this year. He signed up for 1 year of acting classes, every Wednesday night and has been attending classes every week. All had gone well but now they have deicded to change the night to a Thursday night. No consultation, they just sent out a letter for Term III and the acting is now on a Thursday night. My son has soccer training on a Thursday night so it does not suit us. We emaied to complain and got a curt letter saying the terms and conditions on our contract states they reserve the right to change the dates and locations. There is no way we are paying when my son cannot attend so we sent them another email saying we wanted to cancel. We paid approx $400 desosit on a one year contract with the balance paid monthly. Not only do they want to keep the deposit but they also want us to pay 75% of the full year fees!! If we cancel our direct debit what can they do? Is there a chance we will get a bad credit rating? We are really pissed off about it.

Have you read the small print of the contract? If they are correct with what they're saying then I don't think you have any right of complaint unfortunately. If the wording is ambiguous you could have a claim against them.

Shoddy business practice though.

Yes the small print does say they reserve the right to change locations and times :(

If we just cancel the direct debit and tell them to p off what would be the likely consequence? Would we get a bad credit history or worse? They can keey the $400 odd deposit we paid.

Don't know about that. Hopefully someone more into financial legal matters will have some idea though.
