Hello all,

I just wondered if anyone could advise me.

We are currently in the process of applying to Australia under the Business Owner category, with my husband being the main applicant.

But when I read 'Got NZ PR - what about Aus too? ' I wondered if I should be appying. I am a NZ citizen, born there, but came to the UK in 1986. I thought the rules had changed last year in Feb so I was not entitled to apply. But if someone can get NZ PR and then apply for Aus it made me think again. This maybe a much easier way, but what about my husband, who is English and my 3 children, they have NZ passports by decent?


Your thoughts will be appreciated.

I think you're confusing the issue here. A NZ PR (or citizen for that matter) is not barred from applying for an Australian PR visa. The point to note here is that the person who is a new NZ PR has no special benefit when it comes to applying for an Australian PR visa. It's not as if the NZ PR is given an easier route to get an Aussie PR.

As a NZ citizen, you (and your children who are also NZ citizens) are permitted to enter and remain in Australian even without applying for a PR visa. You are entitled to work there as well. Only drawback is that social benefits are not accessible to you while you are not an Aussie PR. Your husband on the other hand, who is not a NZ citizen, will have no such work/residency privileges - he will have to get an appropriate visa in order to live and work in Australia.

NZ citizens can live in Australia but no longer get PR automatically.

You and your children will be entitled to the special visa given to
New Zealand citizens on arrival -
http://www.nz-oz.gov.au

But you would not be able to sponsor your husband for permanent
residence. Instead, all you could sponsor him for would be a
restricted five year visa and if you were to die or your marriage
ended for some reason, his position in Australia would be tenuous with
no rights at all in New Zealand.

Plus, without PR none of you could qualify for certain welfare
benefits or ever apply for Australian citizenship.

So I would still get Australian PR separately if you want to go to
Australia. Otherwise I would be suggesting that you go to New Zealand
for a while, where your husband could get NZ citizenship (and your
children upgrade to full NZ citizenship, they currently won't be able
to pass on NZ citizenship to any future children they have born
outside NZ).

PS The original poster should make sure her migration visa is put in
her New Zealand passport (and the NZ passports of her kids) and not in
her British passport (or the children's British passports).

The reason for this is that if their Aus PR visas are in their British
passports, and they at any point use NZ passports to enter Australia,
the temporary visa granted to New Zealanders will override their
Australian PR visas.

Jeremy, so basically we are best to carry on applying for PR via the Business Owner route. But should I state in the application that my nationality is NZ or British?

If you see your future in Australia, then you really need to get PR,
so yes (assuming you qualify)

Both (the form should have space for this). Same applies for your
kids.

Actually, I need to correct myself here.

It's not legally possible to apply for a Special Category visa (the
temporary visa given to New Zealanders) if you are the holder of a
permanent visa. This stops your PR visa from being accidentally
overriden.

I think this provision was brought in in February 2001 when the rights
of NZ citizens coming to Australia changed.

It probably keeps things simpler to have your visa in your NZ passport
anyway rather than your British one, but it's not a major issue.
