Applying for PR - how soon?
Hi Everyone,
How soon can you apply for PR? We have just received our 457 visa's but they have only been granted for two years. This may hinder my ability to get work. I'm in med sales and they may not employ me unless I have a 4 year visa.
Can we apply for PR right away and if so how long does it take to come through?
Any advice would be really appreciated.

Yes, husband is main applicant (nurse) and we have received 457 visa - employer sponsored. Any ideas?

457 visas can be up to 4 years and are then renewable.
On the online application I requested 4 years but was granted 2 years.
This is probably because the initial contract from my employer only covered 2 years.
Is your hubbies contract for 2 years by any chance ?

He has only qualified in Aug last year and does not have the three years post qual experience. They will waive it for "exceptional cases". Have you read this? It's in booklet five but I'm confused, does that only apply to students?

This is not a written law though. I am about 1 week away from applying for RSMS and have only been here 4 months. My employer thinks I have done a splendid job (hurrah) and wants to push for more security to retain my services. They could keep me locked into a 457 but know I won't stay here on that basis.
I believe it's true to say if all the criteria are met then yes the employer can start the ENS process but proving "exceptional" is not easy so I hope the employer knows what they are talking about or has a good agent who does.
Can your hubby not apply for an independant skills visa in his own right ?
I mean as an individual and not a sponsored category.
Nurses were being fast tracked so applying from within Aus could be pretty quick. That would be so much better for you both.
I would like to here JAJ opinion on these items to confirm what I have said is correct.

I'm a nurse on a 457 - working in Melbourne.
I lodged my application for 136 SI on 22nd feb - money debited from CC day after. I have got a ref number, but no Case Officer as yet - how long should I expect to wait for one?
DIMIA - Adelaise Skilled Processing Centre told me the whole process should take no longer than 12 weeks - but they qualified that by saying that is the ANMC assessment that takes the bulk of time - it actually only took a week!!
My case appears simple as my medicals and PCC are still valid and I believe that nurses are still being 'fast-tracked' ?

At least not as far as DIMIA are concerned, some employers impose arbitrary rules like this before they will sponsor.
Some people go straight for ENS/RSMS, apply offshore, and avoid the 457 completely.

Get professional advice if you want to discuss getting a waiver of the ENS qualification requirement.
Also be aware that ENS rules are likely to change rather fundamentally in the near future.

If one must go on a 457 be aware of the risks and downsides versus permanent residence, especially if the job doesn't work out. Read the thread at the top of the forum.

Indeed the two years I had in mind was for RSMS exceptional appointment criteria.

Can you do as I have done - and apply for PR within a few weeks of arriving in Aus on a 457 (I was here 6 weeks when I lodged my application - arrived on 12th jan).
I am on a sticky wicket in that my visa is only for a year - apparently I 'took over' someone elses nomination as they had returned to UK.
Don't want to be caught short - although as a nurse I hope it doesn't take till next Jan! - also I wanted to apply while my meds and PCC were still valid.
(Couldn't go through my meds being lost again !!! )
Does anybody know how long it is likely to take - did DIMIA give me a fair estimate?
Timeline doesn't really answer my query.
