another citizeship question!
hi guys
have had a search but cant find the "idiots guide to citizenship"!
We are looking at moving in September on a 136 visa. Now, will we have to wait 2 or 4 years before applying? (Am just wondering as the 136 visa is valid initially for 5 years!)

Is the change date in September then? I thought it was in July....

To come under the 2 year rule you need to have validated your visa before the new legislation comes in. So you would have to come out before July 1st, even if it's just to clear customs and then return on the next flight.

Hi Chris,
I confirm that the new legislation applies to people who are granted permanent residence after 1 July.
It is our understanding that a person is regarded as a permanent resident, when the visa is granted. As per the citizenship act therefore, you are a permanent resident (i.o.o)

Basically to be classed as a PR you need to either be resident in Australia or have previously been resident in Australia, which means you would need to have validated. Before you validate, you aren't resident because you haven't been in the country.
