Under the new law, if you spend time on a temporary visa in Australia before you get PR (eg 457 visa, SIR visa, temp spouse visa) you may be able to credit up to 2 years of the time against the 3 year residence requirement.

thanks for explaining that
we are on permanent visas though, and although we have no intention of go anywhere, being citizens here would complete things for us, may sound a bit stupid to some people but it means a lot to us so im hoping we can apply in feb next year and not have to wait the extra year.

I have just copied this text from the Australian Government Citizenship website FAQ:
9. When the new Act is implemented do all permanent residents have to be in Australia for 3 out of the last 5 years?
All people applying after the commencement of the new Act will need to have been permanent residents in Australia for at least 3 of the 5 years prior to application unless they are eligible for one of the exemptions to the residence requirements. There are also some transitional provisions, which are outlined above.
Unless things have moved on since this and they have not updated their website it looks as though you will need to have applied for Australian citizenship prior to the new Act coming into effect to be judged under the 2 year rule.

There is a possibility - no more than that - that the Bill will be amended as it passes through Parliament (further to a Senate committee recommendation). The Citizenship website can only talk about the Bill as it stands.

Thanks Jeremy, I have now found the full list of recommendations. Do you know what the process is for the review and acceptance of these recommendations? I assume a revised version of the Act be put before parliament for review and approval and hence we will be able to see what has been included and what has been ignored from the recommendations list.
